Subject: ROAD AND SURFACE CONSTRUCTION NOISE
EXEMPTION FOR REGION OF UVATERL00 -SPOT
IMPROVEMENTS
RECOMMENDATION:
That the Regional Municipality of Waterloo and its contractor(s) be exempt from the
provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6
Construction Work during the spot improvements contract #2007-027 in the City of
Kitchener. The request for the noise by-law exemption is only between the hours of 7:00
p.m. to 7:00 a.m. for the period from September 4, 2007 to October 31, 2007. Nighttime
works will proceed only during a one (1) week period during the requested timeframe; the
remainder of work will be conducted during daytime hours.
BACKGROUND:
In order to complete the work and minimize traffic disruption for this project, and the fact that
various roadways are affected throughout the contract, some weekend work must take place in
order to complete the project in the time allotment. This exemption is requested in order to
complete the work as required. A full listing of work locations has been attached to this report
although only the locations listed below will require nighttime operations to be completed during
a one (1) week window only.

Courtland Ave. East Siebert Ave. to Hayward Ave. Spot improvements
Ottawa St. South Strasburg Rd. to Westmount Rd. East Spot improvements
Frederick St. Ellen St. East to Lancaster St. East Spot improvements
This project will commence on September 4, 2007 and is scheduled to be completed October
31, 2007. This is allotting 1 to 2 hours per location for grinding and paving.
The noise exemption request primarily includes the need for evening work to complete work and
ideally clean up the site and perform paving and grinding operations. This exemption will
incorporate the work to minimize road closure times and improve traffic flows once the work has
been completed. A total of six (6) locations for nighttime work are scheduled within the City of
Kitchener.
Noise protocol will be followed, which covers administrative measures such as scheduling of
noisy activities at times of least impact, selection of haulage routes to minimize close proximity
to neighbours, and maintaining contact with residents.
A formal schedule for this work is imminent. Accordingly, once more details are provided for
these work locations regarding times and dates, staff will directly advise all members of Council
immediately.
The request for a noise exemption will permit the Region of Waterloo and its Contractor(s) to
complete their work in a safe and efficient manner under the limit set out in the contract. In
order to limit the impact on the nearby residential areas, the contractor will be required to
comply with requirements for equipment maintenance and operation, in that the contractor is
obligated to maintain all equipment in proper working order including proper noise reduction.
In order to expedite the construction and allow extended hours of work to take place for this
project, thereby minimizing traffic impacts, we recommend that this request for a noise by-law
exemption be granted.
FINANCIAL IMPLICATIONS:
None.

COMMUNICATIONS:
The Regional Municipality of waterloo and its contractor will communicate the expectation of
extended working hours to area residents and have been actively advising of any changes as
they develop.
CONCLUSION:
In order to expedite the construction and allow extended hours of work to take place for this
project, thereby minimizing traffic impacts on these arterial roadways, we recommend that this
request for a noise by-law exemption be granted.
