Subject: WORKPLAN FOR REMEDIATION OF COAL TAR IMPACTS -
89JOSEPH STREET
RECOMMENDATION:
1. That the remediation plan for 89 Joseph Street as outlined in the MTE Consultants
Inc. report, entitled, "Workplan for Remediation of Coal Tar Impacts - 89 Joseph
Street" (Workplan} dated September, 2007 be approved and,
2. That the Mayor and Clerk be authorized to enter into an agreement, satisfactory to
the City Solicitor,
a} with the property owner at 89 Joseph Street for the restoration of the lands,
b} with the property owner at 89 Joseph Street for first right of refusal for the
vacant lands if a replacement building has not been re-constructed, and
c} with the property owners at 93 Joseph Street and 7, 11 and 15 Richmond
Avenue, for the purpose of gaining access and conducting restoration work
thereon to complete the Workplan; and further
3. That staff be directed to obtain quotations for the demolition of 89 Joseph Street
as identified in the Workplan.
REPORT:
During the investigation and preparation for the remediation of the Joseph/Gaukel right-of-way
and 44 Gaukel Street site an abandoned storm sewer was planned to be removed from the
above site as it was suspected that the pipe bedding was impacted due to its proximity to the
former coal gasification plant. The exact alignment of the pipe however had not been fully
determined given the age of the pipe. During the excavation of soil within the road allowance
along Joseph Street further subsurface investigation was completed within the property
boundary to determine the location of the pipe and extent of site remediation works for the
property. As a result of this further investigation, the previously mapped alignment of the pipe
does not appear to reflect the actual location. What has been observed is that the pipe is not
located within the side yards of the adjacent dwelling units but rather runs beneath the 89
Joseph Street home. The demolition of the existing dwelling is required in order to complete the
environmental restoration plan. The pipe removal will extend into the park and terminate at an
existing manhole. As part of this removal certain trees within the park along this alignment will
be impacted and Forestry staff are active participants in the planning process in order that we
can minimize the impacts as much as possible.
The current property owner has expressed a desire to retain ownership of the lands and
ultimately relocate to the community once the site has been remediated therefore the site will
be graded and left for the property owner to re-build a new building after consultation and
approval of Heritage Kitchener as it is located within the Heritage Conservation District.
The MTE Consultants Inc. report will be available for viewing in the Clerks office.
FINANCIAL IMPLICATIONS:
The cost for the site remediation and restoration was included in Council's approval of the
remediation costs for the 44 Gaukel Street project.
