HomeMy WebLinkAboutAdjustment - 2002-11-12 SG COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD NOVEMBER 12, 2002 MEMBERS PRESENT: Messrs. S. Kay, P. Britton and D. Cybalski. OFFICIALS PRESENT: Mr. B. Sloan, Planner and Ms. J. Billett, Secretary-Treasurer. Mr. S. Kay, Chair, called this meeting to order at 10:45 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Tuesday, November 26, 2002, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. One sign is proposed to be adjacent to Queen Street North located 31 m (101.70 ft.) from a residential zone rather than the required 150 m (492.12 ft.) and 9 m (29.52 ft.) from the intersection of Queen Street North and Margaret Avenue rather than the required 23 m (75.45 ft.) and having a maximum height of 2.235 m (7.33 ft.) rather than the permitted 1.5 m (4.92 ft.). The second sign is proposed to be adjacent to Frederick Street located 10.67 m (35 ft.) from the intersection of Frederick Street and Otto Street rather than the required 23 m (75.45 ft.). The Committee was in receipt of the following City staff / agency comments and public submissions (if any): Planning Division - November 5, 2002 - in support, as amended to eliminate the variance for the ground sign relative to height and to include variances for the pylon sign relative to distance from a residential zone and obstruction in the sign clearance area; COMMITTEE OF ADJUSTMENT 33 NOVEMBER 12, 2002 1. Submission No.: SG 2002-017 (Cont'd) The following had no concerns or comments with respect to this application: · Director of Building - November 1, 2002 · Traffic & Parking Analyst - October 16, 2002 · Region of Waterloo - October 25, 2002 · Grand River Conservation Authority - November 4, 2002. Mr. S. Kay referred to comments of the Planning Division and reviewed the recommended changes to the variances proposed for the ground and pylon signs with the applicant. Mr. D. Thompson advised that he was in agreement with the recommendations of staff. In response to a question from Mr. S. Kay, Mr. Thompson advised that the Centre in the Square had hosted an Open House for area residents to present their proposal for the new signs, which was well received. Moved by Mr. D. Cybalski Seconded by Mr. P. Britton That the application of the Centre in the Square requesting permission to erect a ground sign containing automatic changing copy adjacent to Queen Street North located 60 m (196.85 ft.) from a residential zone, rather than the required 150 m (492.12 ft.) and 9 m (29.52 ft.) from the intersection of Queen Street North and Margaret Avenue, rather than the required 23 m (75.45 ft.); and to erect a pylon sign containing automatic changing copy adjacent to Frederick Street located 120 m (393.70 ft.)from a residential zone, rather than the required 150 m (492.12) and 10 m (32.8 ft.) from the intersection of Frederick Street and Otto Street, rather than the required 23 m (75.45 ft.), and having a partial panel within the required sign clearance; on Lots 1, 2, 4 to 7 and Part Lot 3, Plan 432, Lot 11 and Part Lot 10, Plan 412, Lots 1 to 3 and Part Lots 4 to 6, Plan 410, Lots 6 to 9 and Part Lots 17 to 19, Plan 401, Lots 5 to 7 & Part Lot 4, Plan 70 and Lot 6, Eby Survey, 101 Queen Street North, Kitchener, Ontario, BE APPROVED, subject to the following condition: That the variances as approved in this application shall be generally in accordance with the drawings submitted with Sign Variance Application, Submission No. SG 2002-017. It is the opinion of this Committee that: 1. The variances requested in this application are minor in nature. 2. This application is desirable for the appropriate development of the property. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property.
