Subject: FREDERICK ST LOT NO. 2 - RETAINING WALL REPAIRS —
NOISE EXEMPTION
RECOMMENDATION:
That the Federal Building (15 Duke Street East) and its contractor(s) be exempt from the
provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6
Construction Work during the retaining wall work in the City of Kitchener. The request
for the noise by -law exemption is only between the hours of 7:00 p.m. to 7:00 a.m. for the
period of weekends only from October 15, 2007 to December 3, 2007.
BACKGROUND:
In order to complete the work and minimize the disruption to Downtown parkers in Lot 2 for this
project, weekend work must take place in order to complete the project in the time allotment.
This exemption is requested in order to complete the work as required. This work is proposed
for weekends.
SCOPE OF WORK:
The scope of the work includes the removal of the top 600 mm of the retaining wall using 7kg
chipper(s) for the length of the wall which is approximately 20 m in length.
DURATION
The contractor plans to undertake this work on weekends until December 3, 2007 with the
following schedule:
Fridays from 3:00 p.m. to 11:00 a.m.
Saturdays from 7:00 a.m. to 11:00 p.m.
Sundays from 7:00 a.m. to 11:00 p.m.
Noise protocol will be followed, which covers administrative measures such as scheduling of
noisy activities at times of least impact, selection of haulage routes to minimize close proximity
to neighbours, and maintaining contact with residents.
In order to expedite the construction and allow extended hours of work to take place for this
project, thereby minimizing traffic impacts, we recommend that this request for a noise by -law
exemption be granted.
FINANCIAL IMPLICATIONS:
None.
COMMUNICATIONS:
The Federal Building at 15 Duke Street East and its contractor will communicate the expectation
of extended working hours to area residents /businesses and have been actively advising of any
changes as they develop.
CONCLUSION:
In order to expedite the construction and allow extended hours of work to take place for this
project, thereby minimizing traffic impacts on these arterial roadways, we recommend that this
request for a noise by -law exemption be granted.
