MINUTES OF THE REGULAR MEETING HELD OCTOBER 16, 2007
MEMBERS PRESENT: Messers. M. Hiscott, B. McColl & A. Head
OFFICIALS PRESENT: Ms. J. von Westerholt, Senior Planner, Mr. R. Parent, Traffic & Parking
Analyst, Mr. B. Cronkite, Traffic Technologist, Ms. D. Gilchrist, Secretary-
Treasurer, and Ms. D. Hartleib, Administrative Clerk.
Mr. M. Hiscott, Vice Chair, called this meeting to order at 9:32 a.m.
The Committee considered a request from City Council to amend the Fence Variance meeting
minutes of September 18, 2007, paragraph 2, page 20.
Moved by Mr. B. McColl
Seconded by Mr. A. Head
That the minutes of the Committee of Adjustment meeting respecting variances to Chapter 630
(FENCE) of the City of Kitchener Municipal Code, dated September 18, 2007, be amended in
paragraph 2, page 20, to show that the corner of Haven Street and Erinbrook Drive is in the "Country
Hills community "and not the "Doon South community".

The Committee considered direction given by City Council on October 1, 2007, "that any other
applications (for Fence Variances) that have been filed with the Committee of Adjustment be deferred
pending the outcome of further consideration by the Development and Technical Services Committee
and Council; and that staff address the issue of any non-compliant fences that pose legitimate safety
concerns in their report."
Staff advised that on the basis of Council's direction, all applicants were advised that they did not
need to attend this meeting.

NEW BUSINESS
In light of Council's direction, the Committee passed the following motion:

Seconded by Mr. A. Head
That consideration of Submission No.'s FN 2007-012 - 74 Isabella Street, FN 2007-013 - 88 Isabella
Street, FN 2007-014 - 200 Ridgemere Court and FN 2007-015 - 201 Ridgemere Court, be deferred
as directed by City Council.

Mr. Burt, applicant in Submission No. FN 2007-015 - 201 Ridgemere Court, was in attendance. He
advised the Committee that he had a fence contractor install his fence. He plans to stain the fence
and put in shrubs and evergreens to screen the fence. He has not completed this work yet, pending
this Committee's decision. He suggested that the Fence By-law requirements should be better
communicated, noting that when he purchased this property he was advised by the developer that he
could not have an above-ground pool, and suggested that information about fencing should also be
given at the same time. He also advised that he paid a premium for a corner lot and feels that he
should not have to lose 5' or 15' of the lot because of the fence regulations. He suggested to the
Committee that when there is no safety problem, fences on corner lots should be approved.

On motion, the meeting adjourned at 10:10 a.m.
