NOVEMBER 19, 2007 CITY OF KITCHENER
A special meeting of City Council was held at 1:05 p.m. this date, chaired by Mayor C. Zehr and with
all members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council considered Development and Technical Services Department report DTS-07-184 (J. Witmer),
dated November 15, 2007, concerning a conditional Offer to Purchase for 278 Clifton Road.
Mr. J. Witmer, Director of Building and Environmental Remediation, advised that as part of an
environmental remediation that took place in the Clifton Road /Guelph Street area four residential
units contained within two semi-detached buildings were required to be demolished. Of the four
residential units, three of the owners did not wish to sell their units whereas one did. Mr. Witmer
further advised that the two semi-detached buildings have now been rebuilt, the three property
owners have taken possession leaving one unit to be sold by the City. The City has received an offer
for purchase of 278 Clifton Road at a price slightly above the asking price for the property and that
the conditions of the offer have now been waived.
Moved by Councillor J. Smola
Seconded by Councillor C. Weylie
"That Council accept the conditional Offer to Purchase 278 Clifton Road, legally described as
Plan 666 PT Lot 96, at the total purchase price of $220,000.; and further;
That the Mayor and Clerk be hereby authorized to execute any other necessary documentation
required by the City Solicitor to complete the sale transaction."

Seconded by Councillor G. Lorentz
"That an in-camera meeting of City Council be held this date to consider a land acquisition /
disposition matter which is also subject to solicitor-client privilege and a matter subject to solicitor-
client privilege."
Councillor B. Vrbanovic asked why the matter of the Consolidated Maintenance Facility was being
discussed in-camera. Ms. L. MacDonald, City Solicitor, advised that previously Council requested
that this matter not move forward without an opportunity to review the agreements. She added that
the reason for in-camera discussion this date was to provide advice and try to answer any questions
Council may have with respect to the agreements.
The motion of Councillor B. Vrbanovic was then voted on and Carried.

Seconded by Councillor K. Galloway
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2007-208 by the Clerk."
Carried.
On motion, the meeting adjourned at 1:11 p.m.
