RECOMMENDATION:
That the recommendations of report DTS-07-121 be replaced by the following recommendation:
That Zone Change Application ZC071051D1JB (58 Daniel Ave, M&L Kovacevic} for the
purpose of changing the zoning from Residential Three Zone (R-3} to Residential Three
Zone (R-3} with Holding Provision 18[H] to prevent any new development until necessary
transportation improvements have been completed in the Bridgeport area, be approved
in the form shown in the attached "Proposed By-law" dated November 13, 2007 without
conditions.
REPORT:
The proposed plan Zone Change application was deferred by DTS Committee to allow a
meeting between the applicant and concerned residents. Several residents attended the DTS
Committee meeting on August 13, 2007 and the issue of compatibility of the proposed new lots
and lot frontage with the existing neighbourhood was expressed by several residents in
attendance. The neighbours were also concerned with the number of new dwelling units being
proposed with this development and the increase of traffic that may result. Residents and the
applicant have since met with City staff and Councillor Smola, but they have been unable to find
an amicable solution. The applicant would now like to proceed with the severance of the
existing dwelling and has agreed to keep the zoning category as Residential Three Zone at this
time. A Holding Provision will still be necessary for the retained vacant lands in order to prevent
any new development until the necessary transportation improvements have been completed in
the Bridgeport area. The applicant has agreed to revise the Zone Change application to
propose a Zone Change from Residential Three Zone (R-3) to Residential Three Zone (R-3)
with Special Holding Provision 18[H].
The applicant has also applied to the Committee of Adjustment to sever the existing building lot
and create a new lot for future residential development. If this severance is approved and the
transportation improvements have been completed, the applicant would be able to apply for a
zone change to lift the holding provision on the vacant parcel and potentially apply for a building
permit to construct a permitted use within the regulations of the Residential Three Zone. If the
applicant wishes to sever additional lots in the future, issues relating to zoning setbacks and lot
width can be addressed through conditions imposed by the committee of adjustment.
CONCLUSION
In accordance with DTS 07-121 and this addendum, City staff recommends that Zone Change
Application ZC07/05/D/JB be approved.
