Subject: ENCROACHMENT AGREEMENT REQUEST -PROPOSED
STAIRS AT 114 BREITHAUPT ST. ONTO BREITHAUPT ST.
ROAD ALLOWANCE
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement,
satisfactory to the City Solicitor, with the property owners} of Part Lot 153, Registered
Plan 376 SPIN 22319-0154 LT}, municipally known as 114 Breithaupt St., to legalize the
encroachment of stairs which will extend 2' 7", more or less, onto the Breithaupt St. road
allowance."
REPORT:
The current owner of 114 Breithaupt St. would like to reconstruct the porch and stairs in front of
the property. The proposed front porch is intended as a replacement for an old porch that has
recently been removed for safety reasons. The stairs of the original porch encroached
approximately 2' 7"onto the City's road allowance as illustrated on the attached survey.
The owner intends to rebuild the porch as a single storey with a roof on the same footprint as
shown on the survey. The owner has received a Minor Variance on November 20, 2007 for this.
The proposed stairs leading from the porch would encroach approximately 2' 7" onto the City's
Breithaupt St. road allowance in approximately the same location as the original stairs.

CONCLUSION:
The appropriate staff has reviewed this request and has no concerns with entering into an
encroachment agreement with the property owner(s) of 114 Breithaupt St. for the purpose of
legalizing the portion of the proposed sidewalk on the City's road allowance.
