RECOMMENDATION: That the Mayor and Clerk be authorized to execute a Release and Waiver with Bingemans Inc. for the use by the City of Kitchener Fire Department of its wave pool facilities for the purpose of water rescue training for the 2007 through 2010 water seasons, if agreed to each season, said release to be satisfactory to the City Solicitor. EXECUTIVE SUMMARY: N/A BACKGROUND: Bingemans Inc.has offered to the Fire Department, at no cost to the municipality, the use of its wave pool facility for the purpose of training fire personnel on water rescue techniques, said training to take place at mutually agreed upon times. REPORT: The Fire Department's water rescue committee recognizes this to be a good resource for training because the wave pool simulates natural conditions and allows the use of all relevant equipment during the training, in a limited area. Training in the pool provides increased safety during the training, the ability to shut off the waves if needed, secure and stable footing, good water quality, and no risk of debris washing down stream. The Fire Department is anxious for these arrangements to commence training immediately. In exchange for the use of its facility, Bingeman has asked the municipality for indemnification against property damage and/or injuries that could be sustained as a result of such activities. The Release and Waiver is structured to address any use of Bingeman's wave pool facility by the Kitchener Fire Department, for water rescue training, for the 2007 water season through and including the 2010 water season, concluding prior to the end of this Council's term. FINANCIAL IMPLICATIONS: N/A COMMUNICATIONS: N/A CONCLUSION: Use of Bingeman's wave pool provides the Fire Department with a safe facility to conduct its water rescue training.
