Submitted By: Ken Currier, Director of Operations
Prepared By: Peter Wetherup, Parks Planner
Ward(s) Involved: Forest-Rockway (5)
Date of Report: August 1, 2007
Report No.: CSD-07-073
Subject: RENEWAL OF TWO PARK LICENSE AGREEMENTS (PTLT
37, get & PTLTS 36 & 37, gct)
RECOMMENDATION:
That subject to the satisfaction of the City Solicitor, the Mayor and Clerk be authorized to
execute License Agreement Renewals (5 years) with Ontario Realty Corporation (formerly
Hydro One Networks Inc) relating to lands in the Forest Heights community, more
particularly described as Part Lot 37, German Company Tract and Part Lots 36 & 37,
Germany Company Tract, giving the City a license to use and allow the public to use
those lands.
REPORT:
The one license area includes the area from Bent Willow Drive to the walkway connecting
Trailwood Crescent and Willow Green Court. It is approximately 5.22 acres (2.11 ha) and
contains both a concrete sidewalk connecting Brent Willow Drive to the walkway and a portion
of community trail leading to Highview Drive.
The second license area includes the hydro corridor running from the walkway connecting
Trailwood Cres. and Willow Green Court to Meadowlane Park crossing Driftwood Drive (twice)
and Royal Orchard Drive. It is approximately 26.1 acres (10.6 ha) and contains approximately
1900 metres of community trail plus the emergency access for Royal Orchard Place.
The City has 36 parcels of land under license with Hydro One Networks Inc. (changing to
Ontario Realty Corporation) comprising of approximately 84 acres (38 ha) throughout the City
and containing 7.2 miles (11.5 km) of community trail.
License renewal is now on a 5 year basis and we have licenses expiring in 2007, 2011 and
2023 that will be renewed (license length has varied from 5-20 years over the years).
The City entered into the licenses with Ontario Hydro as the need arose for the extension of the
community trail system and open space system. These portions have been under license since
1984 and 1986.
Report No: CSD-07-073
FINANCIAL IMPLICATIONS:
The Park License is being offered at a yearly rate of a nominal sum of $2.00 and the
municipality is responsible for 50% of the realty taxes (approximately $416 per acre).
Hydro One is responsible for maintenance of the corridor save and except that portion within
Meadowlane Park.
