Proulx, Director of Facilities Management Ward(s) Involved: Date of Report: March 21, 2007 Report No.: CRPS: 07-043 Subject: DELEGATE SIGNING AUTHORITY TO DIRECTOR OF FACILITIES MANAGEMENT FOR PLANNING AND BUILDING PERMIT APPLICATIONS RECOMMENDATION: That Council delegate signing authority to the Director of Facilities Management, or his designate, to execute on behalf of the City, any planning and building permit applications for approved City projects, as well as any documentation accessory to those applications to acknowledge the City's commitment to comply with any terms and conditions imposed as part of said applications, provided same are satisfactory to the City Solicitor. EXECUTIVE SUMMARY: N/A BACKGROUND: N/A REPORT: The Corporation of the City of Kitchener is a developer when it constructs or alters facilities. It is required to comply with the laws of the land and as such needs to file certain applications pursuant to the Planning Act and the Building Code Act and to comply with its regulations. Part of the Construction Project Manager's role is to process the necessary applications, as is the case for any other developer. Some of these forms require signatures of the applicant and they usually suggest in their wording that the applicant has authority to bind the Corporation as its agent. The Corporation's agent is treated in most respects equally to any other developer, but it is acknowledged that the Corporation does not enter into agreements with itself; therefore, the planning process falls just short of formal signing of section 41 agreements and the provision of letters of credit. Staff in FM have been following the processes, however, the authority was taken for granted. The purpose of this report is to formally empower staff to commit the Corporation to the implementation of the development standards as all other developers do in Kitchener. This is simply an administrative issue. FINANCIAL IMPLICATIONS: Compliance with planning requirements always has a substantial cost, however, this component of cost is taken into consideration when budgeting for projects; therefore, no additional funds are required.
