Riordan, Administrative Assistant Ward(s) Involved: West Victoria Park 6 Date of Report: May 8, 2007 Report No.: CRPS 07-066 Subject: DECLARE SURPLUS TO THE CITY'S NEEDS -LAND LOCATED DIRECTLY BEHIND 212 COURTLAND AVENUE EAST RECOMMENDATION: That the City declare as surplus to its needs vacant land measuring approximately 50 by 45 feet located directly behind 212 Courtland Avenue East in Kitchener, more particularly described as Part Lots 12 and 21 of RP390; and, That Legal Services be directed to convey Part Lots 12 and 21 of RP390 to the property owner of 212 Courtland Avenue at fair market value, plus all incidental costs subject to the execution of an agreement of purchase and sale satisfactory to the City Solicitor; and further, That the Mayor and Clerk be authorized to execute the necessary documentation to complete the conveyance. EXECUTIVE SUMMARY: N/A BACKGROUND: The parcel at the rear of 212 Courtland Avenue East was originally expropriated by the City for the enlargement of Kaufman Park by By-law 5560 in 1965. Back in 1967 the owner of 212 Courtland Avenue requested permission to purchase the parcel. At that time, Parks and Recreation Commission agreed to lease the parcel to the owner of 212 Courtland Avenue. A garage was constructed on the parcel prior to 1980 without City approval. In 1986 the City was approached again from the owner of 212 Courtland requesting to purchase the parcel. After review, the City agreed to sell but the purchaser expected to receive it at lower than market value so he withdrew his offer. REPORT The City was recently approached by a prospective purchaser of 212 Courtland Avenue requesting that the City sell the parcel located directly behind 212 Courtland Avenue East. His decision on the purchase of 212 Courtland is subject to the City approving this recommendation. The City owned parcel at the rear of 212 Courtland Avenue is zoned R-5. It's been confirmed that there would be no zoning issues if the City were to sell this piece of property to the owner of 212 Courtland Avenue. This parcel of land has been discussed at several Property Management Committee meetings. Staff are in support of this sale. The committee foresees no impact to Kaufman Park. Notice to the public is given by way of listing on the Council or Committee of Council agenda. An appraisal will be required at the purchasers' expense to establish fair market value. FINANCIAL IMPLICATIONS: The purchaser to pay fair market value for the land and all costs associated with the appraisal, reference plan and all incidental costs.
