McCrea, Assistant City Solicitor Ward(s~ Involved: Ward 1 Date of Report: January 8, 2008 Report No.: CRPS-08-004 Subject: LICENSE AGREEMENT BETWEEN CITY AND REGION OF WATERLOO FOR TEMPORARY MODULAR BRIDGE AT BRIDGEPORT BRIDGE RECOMMENDATION: That the Mayor and Clerk be authorized to execute a License Agreement satisfactory to the City Solicitor with the Regional Municipality of Waterloo to use certain lands described as Parts 1, 3 and 4 on Reference Plan 58R-2719, municipally known as 624 Lancaster Street and Part Lots 5 and 6, Plan 577 and Part Lot A, Plan 577, municipally known as 6 and 8 Bridge Street East for the construction of a temporary modular bridge to be used for vehicle and pedestrian access during the restoration of the Bridgeport Bridge. BACKGROUND: The Region of Waterloo is planning to make extensive repairs to the Bridgeport Bridge in the 2009 construction season. As a result of the bridge restoration it will be necessary to build a temporary modular bridge in 2008 to manage vehicle and pedestrian access during the restoration. The proposed location for the temporary bridge is on or adjacent to lands owned by the City. REPORT: The Region wishes to enter into a License Agreement with the City for a three year term over all of 624 Lancaster Street and a small strip along the frontage of 6 and 8 Bridge Street East for the construction of the temporary modular bridge. The only impact to 6 and 8 Bridge Street East would be the temporary installation of a curb and sidewalk on the lands. In the event it is necessary to remove any signage, flag pole or other structures on the City's land, the Region will erect such temporary signage as the City deems appropriate and upon termination of the License Agreement, will replace any such signage, flag pole or other structure to the City's satisfaction. Under the terms of the proposed license agreement the Region will be responsible to restore the City's lands to their original condition, at the Region's cost, at the end of the term. The term of the License Agreement shall commence on February 1, 2008 and shall expire on the later of October 29, 2010 or completion of the restoration project. FINANCIAL IMPLICATIONS: The Region will be responsible for all costs associated with the construction of the temporary modular bridge and the restoration of the City's lands at the end of the term of the license. COMMUNICATIONS: Engineering staff approved the Region's request for the said License Agreement. Facilities Management staff approved the Region's request subject to the necessary safety precautions being taken due to the proximity of children at the day care operation located at 8 Bridge Street East.
