Zehr and Members of Council Date of Meeting: January 28, 2008 Submitted By: Alain Pinard, Long Range & Policy Planning, 519-741-2319 Prepared By: Michelle Wade, Heritage Planner, 519-741-2839 Ward(s) Involved: 6 Date of Report: January 23, 2008 Report No.: DTS-08-027 Subject: EXTENSION TO THE TIMEFRAME FOR FORMAL CONSIDERATION HERITAGE PERMIT APPLICATION (HPA-2007-IV-009) 307 QUEEN STREET SOUTH RECOMMENDATION: That pursuant to Section 33(5) of the Ontario Heritage Act, the timeframe for formal consideration of Heritage Permit Application HPA 2007-IV-009 (307 Queen Street South) be extended to April 30, 2008 to provide additional time for the applicant to examine and find the most economically feasible option for replacing all of the building's window systems. BACKGROUND: Section 33(4) of the Ontario Heritage Act allows a municipality 90 days to render a decision on a complete heritage permit application; however, if no decision is rendered within that timeframe the council shall be deemed to have consented to the application. Section 33(5) of the Ontario Heritage Act provides that the applicant and Council may agree to extend the timeframe for formal consideration of a Heritage Permit Application. At the October 22, 2007 Council meeting, the timeframe for formal consideration of Heritage Permit Application HPA 2007-IV-009 X307 Queen Street South) was extended to January 31, 2008 to provide additional time for the applicant to examine possible alternatives to replacing all of the building's window systems. REPORT: Recognizing that the January 31, 2008 timeframe was approaching, staff contacted the applicant to ascertain their intentions regarding HPA 2007-IV-009. In their correspondence, staff outlined the following three options to the applicant: (1 } proceed with the original application; (2} request an additional extension; or, ~3) withdraw the application. On January 21, 2008 the agent acting on behalf of the applicant provided staff with an update on the status of HPA 2007-IV-009. The agent confirmed that the cost of the window replacement as presented in the original heritage permit application came in above budget. As a result, the agent is exploring the possibility of alternative window systems in an attempt to find an economically feasible option. Accordingly, the applicant has requested an additional extension of 90 days in order to consider alternatives and revise the heritage permit application. Staff have no concerns with this request and thus recommend approval of the request for an extension to the timeframe for formal consideration of HPA-2007-IV-009. Please note that due to the time constraints this request was not considered by Heritage Kitchener. FINANCIAL IMPLICATIONS: None. CONCLUSION: Staff are recommending approval of the request for an extension of 90 days to the timeframe for formal consideration of HPA-2007-IV-009.
