Subject: CONVEYANCE OF BLOCKS C TO L ON PLAN 1168 TO
RESPECTIVE ADJACENT LAND OWNERS
RECOMMENDATION:
That Blocks C to L on Plan 1168 be declared surplus to the City's needs; and further
That Legal Services be instructed to proceed with the preparation of a Transfer or Quitclaim
Deed or further documentation, as the case may be, to effect the conveyance of Blocks C to L
on Plan 1168, to the respective adjacent owners, as required; and further
That the Mayor and Clerk be authorized to execute the required documentation to effect the
conveyances, as approved by the City Solicitor.
EXECUTIVE SUMMARY:

BACKGROUND:
Blocks C to L on Plan 1168, as shown on the attached Sketch A, were established in 1964 to
create temporary turning circles on Belton Drive and Weichel Street in Kitchener. As the streets
were extended beyond the area intended for temporary turning circles, as shown on the
attached Sketch B, these temporary turning circles created by Blocks C to L were no longer
required. The intent was to convey the parts to the adjacent properties.
REPORT:
The purpose of this report is to remove any cloud on title which affects these lands. In these
two situations the Blocks of the land forming the turning circle have not been conveyed to the
owners of the adjacent lands. These Blocks serve no purpose to the City, have no value and
should be conveyed as originally intended.

CONCLUSION:
With this surplus declaration, the City Solicitor may convey the applicable parcels to the owners
of 108 Weichel Street and 47 Belton Drive.
