McColl OFFICIALS PRESENT: Ms. J. von Westerholt, Senior Planner, Mr. R. Parent, Traffic Analyst, Ms. D. Gilchrist, Secretary-Treasurer, Ms. D. Hartleib, Administrative Clerk. Mr. M. Hiscott, Vice Chair, called this meeting to order at 11:11 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday February 25, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2008-001 Applicant: Irving Underman Limited Property Location: 413 Highland Road West Legal Description: Part Lot 38, Plan 786, being Part 1, Reference Plan 58R-1089 Appearances: In Support: D. Nong Contra: None Written Submissions: None The Committee was advised that the applicant requesting permission to erect a fascia sign with a projection of 0.61 m (2') from the wall rather than the permitted projection of 0.4m (1.31') and permission to erect a ground sign with a height of 5.64m (18.5') rather than the permitted height of 4.5m (14.76'). The Committee considered the report of the Development and Technical Services Department, dated February 8, 2008, advising the subject property is located on the south side of Highland Road West between Westmount Road and Butler Lane. The zoning is C-6 (Arterial Commercial) Zone under By-law 85-1 and has an Official Plan designation of Mixed Use Node. The applicant is requesting permission to construct a fascia sign with a projection of 0.61 m (2 ft) from the wall rather than the permitted maximum projection of 0.4 m (1.31 ft) and permission to construct a ground supported sign with a height of 5.64 m (18.5 ft) rather than the permitted maximum height of 4.5 m (14.76 ft). In regards to the variance staff has considered the tests for minor variances as outlined in Section 45(1) of the Planning Act, R.S.O., 1990 Chap. P. 13, as amended, Planning staff offer the following comments. The variances meet the intent of the Sign By-law which is to ensure that signage does not dominate the fagade of the building (fascia) or streetscape of the neighbourhood (ground- supported sign). The fascia sign is be located on a north side elevation of the building and is modest in area. The ground-supported sign also is of an appropriate size for the lot width and it will not adversely affect the aesthetics of the property. COMMITTEE OF ADJUSTMENT 2 FEBRUARY 19, 200$ 1. Submission No.: SG 2008-001 tCont'd) The variances could be considered minor in nature for the following reason. The projection of the fascia sign is not onerous considering the size of the building. The sign is to be constructed onto a "bow" that projects from the wall, which is a standard corporate design for this corporation. The variance request for the ground-supported sign is also considered minor as the difference is height in only slightly more than 1 m and could be considered a suitable height for the lot width. The variance is appropriate for the development and use of the land for the following reason. The signage is appropriate for the size of the lot and the location of the building. Staff is of the opinion that the proposed signs will not adversely affect the streetscape of the surrounding commercial neighbourhood. The applicant is advised that the existing Landscape Plan for the property is required to be updated to indicate the location of the ground-supported sign. The Committee considered the report of the Region of Waterloo Transportation Planner, dated February 11, 2008, advising that they have no concern with this application. Moved by Mr. A. Head Seconded by Mr. B. McColl That the application of Irving Underman Limited requesting permission to erect a fascia sign with a projection of 0.61 m (2') from the wall rather than the permitted projection of 0.4m (1.31') and permission to erect a ground supported sign with a height of 5.64m (18.5') rather than the permitted height of 4.5m (14.76'), on Part Lot 38, Plan 786, being Part 1, Reference Plan 58R- 1089, 413 Highland Road West, Kitchener, Ontario, BE APPROVED. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the Chapter 680 (SIGN) of the City of Kitchener Municipal Code is being maintained on the subject property.
