Subject: Chapel Hill Drive Drainage Issues
RECOMMENDATION:
That the construction of storm sewer and stormwater channel along the property line
between 16 and 26 Chapel Hill Drive be approved to resolve drainage issues, with the
costs of design and construction to be shared equally by the owners of 16 and 26 Chapel
Hill Drive and the City of Kitchener, and;
That the Mayor and Clerk be authorized to execute an Agreement with the residents of 16
and 26 Chapel Hill Drive to provide an easement to the City of Kitchener for the
construction and maintenance of the storm sewer and stormwater channel, on terms
and conditions satisfactory to the City Solicitor.
REPORT:
The Caryndale Community Plan of Subdivision was approved by the Township of waterloo. The
subdivision and surrounding lands were later annexed into the City of Kitchener and are now
within the City's jurisdiction. The City is responsible for the road network improvements,
reconstruction and maintenance of the road and other services within this subdivision.
Storm sewer drainage from Chapel Hill Drive is currently being discharged through the swale in
between two private properties, being 16 and 26 Chapel Hill Drive, along with overland drainage
flows from those properties. During the heavy storm events over the past several years, the high
flow through the swale has resulted in extensive soil erosion and several trees are being
undermined. The respective property owners have major concerns over this damage to their
property. The existing storm water road outlet design through the swale between the two private
properties is in accordance with the original subdivision design (Township of waterloo). Under
the City's current subdivision standards, the discharge of road drainage through a private swale
would not be permitted.
Mrs. Ruth Hill, the property owner of 26 Chapel Hill Drive approached the City and requested
that the drainage issues be addressed as soon as possible to avoid any further erosion and
undermining of their trees. These trees are very old and some of the trees are leaning towards
both houses (16 and 26) and she fears may cause damages to their houses. Further, Mrs. Hill
hired a consultant, Planning & Engineering Initiatives Ltd (PEIL) to complete the design of the
storm sewer and stormwater channels to rectify the drainage issues.
City staff had several meetings with the property owners and their consultant to investigate the
drainage issues and proposed remedy. Through the analysis, City staff are of the view that the
existing swale between 16 and 26 Chapel Hill is insufficient to receive the combined storm
drainage from the road and the two affected properties which has caused the erosion and
undermining of adjacent trees. The affected property owners (16 and 26 Chapel Hill Drive)
therefore are willing to cost share equally with the City the construction of the storm sewer and
stormwater channel to reduce further damages to their respective properties. Further, the
property owners are also willing to grant an easement free of cost to the City to construct and
maintain these outfall structures.
The estimated cost of the proposed works is about $45,000 (see attached drawings). The City's
contribution towards this project will be $15,000.
City staff recommend that this initiative to address the road drainage outfall that is contributing
to the erosion of the swale between 16 and 26 Chapell Hill Drive properties be approved.
FINANCIAL IMPLICATIONS:
The City would fund one third of the total cost to fix the drainage issue, which amounts to
$15,000. The funding is available in the Storm Water Management account # 315905.
CONCLUSION:
Due to the erosion of the swale resulting from the combined storm drainage discharge from
Chapel Hill Drive and the properties known as 16 and 26 Chapel Hill Drive, staff recommend
that City cost share one third of the cost towards the construction of the proposed storm sewer
and storm water channel. Further, staff recommend that the City accept an easement from the
16 and 26 Chapel Hill Drive residents for the operation and maintenance of the channel.
