Weylie Chair and Members of Development and Technical Services Committee Date of Meeting: April 21, 2008 Submitted By: Grant Murphy, Director of Engineering Services Prepared By: Grant Murphy, Director of Engineering Services Wards} Involved: Ward 4 Date of Report: April 14, 2008 Report No.: DTS-08-055 Subject: EXTENSION OF PURCHASE ORDER FOR CONSULTING SERVICES - UPPER BLAIR CREEK FUNCTIONAL DRAINAGE STUDY RECOMMENDATION: THAT Council approve the extension of the purchase order for consulting services to Stantec Consulting for the amount of $155,000 plus GST for work completed on the Upper Blair Creek Functional Drainage Study, as part of the current Ontario Municipal Board Appeal in the Doon South Community Plan (Phase 2), and to be allocated from the Development Charges Fund -Engineering Studies (Index Code 861061). REPORT: City staff initiated the Upper Blair Functional Creek Drainage Study (FDS), with the primary objective to develop a comprehensive stormwater management implementation strategy, with the capacity to mitigate the potential hydrologic and hydrogeologic impacts associated with development at typical urban densities; in order to achieve the objectives of the Blair, Bechtel and Bauman Creeks Subwatershed Plan. In 2003, the Upper Blair Creek FDS was started in cooperation with the Grand River Conservation Authority (GRCA), the Region of Waterloo and the City of Kitchener. The City took the lead in completing the study and a Technical Steering Committee was formed which included the GRCA, the Region, the City, and members of the Waterloo Region Homebuilders Association (WRHBA). In August 2003 Stantec Consulting was hired to complete the Upper Blair Creek Functional Drainage Study. In May 2004, a Public Information Centre was provided to review aspects of the Study and share the mandate with the public. Since this time much effort has been expended on technical and engineering activities related to the Study and the Technical Steering Committee have met many times with staff and other agencies to discuss the results of the work. In June 2007, a draft report was issued by the City to members of the Technical Steering Committee for their comments. In October 2007, the final draft report was issued and approved by the GRCA Board. City staff had expected to submit the Upper Blair Creek FDS to Council for their approval. Due to an OMB appeal by landowners in the Doon South Community Plan (Phase 2), which covers the east side lands of the Functional Drainage Study, the final report was not delivered to Council for their consideration. During the OMB appeal process, some landowners requested that the report findings be reviewed and reconsidered. Since December, 2007 the City has been working with the GRCA, Region and to review these concerns. City staff have spent hundreds of hours in OMB mediated technical sessions, reviewing information and responding to issues. Further, the City has retained Stantec Consulting Inc. to provide expert advice, complete additional technical and engineering work for the balance of the OMB Appeal process. Due to this additional scope of work, City staff are recommending that additional funds be approved for work completed on the Upper Blair Creek FDS, as part of the current Ontario Municipal Board Appeal in the Doon South Community Plan. Some of this work has been already been completed but further work will still be necessary and is estimated to be for the amount of $155,000 plus GST. As Stantec Consulting are familiar with the current study findings and technical recommendations it is reasonable to extend the existing purchase order for consulting services to them. FINANCIAL IMPLICATIONS: There are funds available to complete this additional scope of work and will be assigned from the Development Charges fund, specifically $155,000 (plus GST) will be allocated from Engineering Studies (Index Code 861061). CONCLUSION: In order to complete additional technical review, monitoring and revisions to the Upper Blair Creek FDS, as part of the current Ontario Municipal Board Appeal in the Doon South Community Plan (Phase 2), the City requires the extension of the current purchase order to accommodate for the change in scope of work that Stantec Consulting had originally been assigned to carry out.
