HomeMy WebLinkAboutCouncil - 2008-04-21 SSPECIAL COUNCIL MINUTES APRIL 21, 200$ CITY OF KITCHENER A special meeting of City Council was held at 4:30 p.m. this date, chaired by Mayor C. Zehr with the following members present: Councillors C. Weylie, J. Smola and K. Galloway. Councillor J. Gazzola was in attendance for part of the meeting. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council considered Community Services Department report CSD-08-037 (J. Witmer), dated April 14, 2008, requesting approval to pay expenditures related to winter ice and snow maintenance. Moved by Councillor K. Galloway Seconded by Councillor C. Weylie "That payment to the listed companies for the following expenditures related to winter ice and snow maintenance, be approved: Contractors Dispatch - $96,761.25 Sousa Concrete - $17,374.90 Moorefield Excavating - $12,600.00." Carried. Councillor J. Gazzola entered the meeting. Council considered Corporate Services Department report CRPS-08-051 (F. McCrea), dated April 17, 2008, regarding surplus land on portions of Pinnacle Drive and Homer Watson Boulevard. Moved by Councillor J. Smola Seconded by Councillor C. Weylie "That a portion of Homer Watson Boulevard, closed by Regional By-law 08-017, described as Part of Biehn's Unnumbered Tract and designated as Parts 1, 2, 3, 4, 5 and 10 on Reference Plan 58R-16072, in the City of Kitchener, be declared surplus to the City's needs; and, That a portion of Pinnacle Drive, closed by By-laws 89-116 and 89-175, as amended, described as Part of Biehn's Unnumbered Tract and designated as Parts 6, 7, 8 and 9 on Reference Plan 58R-16072, in the City of Kitchener, be declared surplus to the City's needs; and, That a portion of Homer Watson Boulevard, closed by By-law 7033, described as Part of Biehn's Unnumbered Tract and designated as Part 11 on Reference Plan 58R-16072, in the City of Kitchener, be declared surplus to the City's needs; and further, That part of Block 129, Plan 1710 and designated as Part 12 on Reference Plan 58R-16072, in the City of Kitchener, be declared surplus to the City's needs." Carried. Council considered a recommendation arising from the Finance and Corporate Services Committee meeting held this date regarding an exemption to Chapter 450 (Noise) for Downtown street cleaning. Moved by Councillor J. Smola Seconded by Councillor J. Gazzola "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to permit the Community Services Department, through an independent contractor, to undertake cleaning of the streets and sidewalks in the Downtown Core between the hours of 10 PM and 6 AM on various dates between May 4 and May 10, 2008." Carried. SPECIAL COUNCIL MINUTES APRIL 21, 200$ - 104 - CITY OF KITCHENER Council considered a recommendation arising from the Finance and Corporate Services Committee meeting held this date regarding a request to operate hot dog carts at 273 Stoke Drive and 112 Wexford Crescent during a community garage sale. Moved by Councillor C. Weylie Seconded by Councillor J. Smola "That the request of Les Halat to operate two hot dog carts at 273 Stoke Drive and 112 Wexford Crescent during an annual Community Garage Sale on May 3, 2008, be approved, provided the necessary licence is obtained, including Health and Fire approvals." Carried. Council considered a recommendation arising from the Finance and Corporate Services Committee meeting held this date regarding a request to operate a hot dog cart at 106 Stoke Drive during a community garage sale. Moved by Councillor J. Smola Seconded by Councillor C. Weylie "That the request of Zbigniew Wilk to operate a hot dog cart at 106 Stoke Drive during an annual Community Garage Sale on May 3, 2008, be approved, provided the necessary licence is obtained, including Health and Fire approvals." Carried. Council considered a recommendation arising from the Finance and Corporate Services Committee meeting held this date regarding a request to extend a Place of Refreshment Licence for Cafe Azzuro, 347 Lancaster Street West. Moved by Councillor J. Smola Seconded by Councillor C. Weylie "That the temporary Class A -Place of Refreshment Licence for Cafe Azzuro, located at 347 Lancaster Street West, be extended until June 30, 2008." Carried. Moved by Councillor C. Weylie Seconded by Councillor K. Galloway "That an in-camera meeting of City Council be held this date to consider a matter subject to solicitor-client privilege." Carried. Moved by Councillor J. Smola Seconded by Councillor J. Gazzola "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2008-74 by the Clerk."
