DTS-0$-051 - ON-STREET PARKING -GRIFFIN AVE The Committee considered Development and Technical Services Department report DTS-08- 051, dated April 1, 2008, recommending prohibition of on-street parking on the west side of Griffin Avenue, from Liberty Avenue to Melrose Avenue. Councillor Smola noted that, during the times when major events were taking place at the Auditorium (KMAC), he received complaints from residents of Melrose Avenue, Dumphries Avenue and Borden Avenue, about the impossibility of getting down the street, due to the amount of snow combined with on-street parking. He directed staff to put a procedure in place to make these streets a priority for snow removal prior to major events taking place at KMAC. Councillor Weylie directed staff to implement an identification system for the parking lot at KMAC, to make it easier for people to find their parked vehicle, such as putting section numbers on light poles within the parking lots. On motion by Councillor J. Smola - It was resolved: "That on-street parking be prohibited at anytime on the west side of Griffin Avenue from Liberty Avenue to Melrose Avenue; and further, That the Uniform Traffic By-law be amended accordingly." 2. DTS-0$-037 - PARK DEDICATION POLICY AND BY-LAW The Committee considered Development and Technical Services Department report DTS-08- 037, dated April 11, 2008, recommending replacement of Chapter 273 (Park Dedication) of the City of Kitchener Municipal Code, and implementation of a Council Policy respecting Park Dedication. Mr. Pinard reviewed the staff report noting that although there is a park dedication by-law, there has never been a policy on how to administer the by-law. The main focus of the policy and by- law being proposed is that currently an appraisal is conducted for all acquisitions; however, this process is not sound, as in many instances the cost of the appraisal is equal to or more than the contribution. A further change proposed in these documents is to collect park dedication for all classes of land. Currently park dedication is not collected for industrial land; however, the Planning Act allows fora 2% contribution for industrial and commercial land. The last major change from the City's current practice deals with clarifying the rules for park dedication for re- development sites. Councillor Gazzola questioned the current situation respecting park dedication for the re- development at Sportsworld and Mr. Willmer responded that this report and proposed policy are a result of that situation; although the policy respecting re-development sites applies to more than just that one site. DTS-0$-037 -PARK DEDICATION POLICY AND BY-LAW tCONT'D) Mr. Willmer advised that is his understanding that Sportsworld is in agreement with the staff recommendations in this report. On motion by Councillor J. Gazzola - It was resolved: "That the Park Dedication By-law (Chapter 273 of the City of Kitchener Municipal Code) be repealed and replaced with the Proposed By-law dated April 11,2008 attached to Development and Technical Services Department report DTS-08-037; and, That the proposed policy attached to Development and Technical Services Department report DTS-08-037 be approved in principle as the City of Kitchener Park Dedication Policy, with the final policy to be brought back for approval following completion of land class appraisals; and, That staff obtain appraisals for the classes of land set out in the proposed policy; and further, That the current practice of exempting all Downtown development from park dedication be reconsidered in the context of the upcoming review of Downtown development incentives, including those offered under Community Improvement legislation." 3. DTS-0$-049 - PERFORMANCE SECURITIES FOR SITE PLAN DEVELOPMENTS The Committee considered Development and Technical Services Department report DTS-08- 049, dated April 11, 2008, recommending amendments to Council Policy I -1080 -Performance Securities. Mr. Willmer reviewed this report, noting this issue is also being addressed because of Sportsworld, but has been an issue in the past. The changes being recommended in this report will also benefit other large re-development projects. In response to questions from Councillor Gazzola, Mr. Willmer advised that Sportsworld is in agreement with the staff recommendation, and the policy was never previewed with other developers because it is less onerous than the existing policy. On motion by Councillor J. Gazzola - It was resolved: "That Council Policy I -1080 (Performance Securities) dated March 1, 1999 and amended November 9, 2000 be revised by adding the following; 2. c) The performance security is not to be reduced below 25% of the cost of all site development works (50% of the original value of the performance security) or $250,000, whichever is the lesser, until the City has received all required Site Development Works Notification Forms, giving complete certification of the site, and the City is in complete agreement with the certification. That clause 3 of Council Policy I -1080 (Performance Securities) dated March 1, 1999 and amended November 9, 2000 be deleted and replaced with the following; 3 a) If a cost estimate is not completed to the satisfaction of the Director of Planning, the calculations for Letters of Credit Based on Lot Area, Frontage and Use be based on the amounts as set out in the annual Fees and Charges By-law, to calculate the amount of the performance security. 3 b) After satisfactory completion of all site development works, the total amount of security held by the City shall be released; and further, DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES APRIL 21, 200$ - 27 - CITY OF KITCHENER 3. DTS-0$-049 - PERFORMANCE SECURITIES FOR SITE PLAN DEVELOPMENTS tCONT'D) That the Urban Design Manual, Letter of Credit Policy, Letter of Credit Release section, page DS-E-1.11, clause 4, be modified to reflect 2. c) above." 4. DTS-0$-054 -CORPORATE INVOLVEMENT WITH REGIONAL EMS WORKING GROUPS The Committee considered Development and Technical Services Department report DTS-08- 054, dated April 3, 2008, recommending that the Fire Chief become involved with various Regional EMS working groups. Mr. Beckett reviewed the report noting that these working groups have come about as a result of the Regional EMS Master Plan. The first working group will look at options for the existing 4 dispatch model. The second working group will look at traffic signal pre-emption, as there are a number of issues around prioritizing. Mr. Beckett assured the Committee that any recommendations from these working groups will be communicated to Corporate Management Team and Council. On motion by Mayor C. Zehr - It was resolved: "That the Fire Chief participate on the Region of Waterloo Traffic Signal Pre-Emption working group; and, That the Fire Chief and a representative from Human Resources participate on the Region of Waterloo Dispatch Model Review working group; and further, That the Fire Chief provide regular updates to Corporate Management Team and Council on the status of the projects." 5. DTS-0$-055 - EXTENSION OF PURCHASE ORDER FOR CONSULTING SERVICES - UPPER BLAIR CREEK FUNCTIONAL DRAINAGE STUDY The Committee considered Development and Technical Services Department report DTS-08- 055, dated April 14, 2008, recommending the extension of the purchase order for consulting services in connection with the Upper Blair Creek Functional Drainage Study, as part of the current Ontario Municipal Board appeal regarding the Doon South Community Plan Phase 2. Mr. Murphy explained the staff report noting that since December 2007, as a result of the Ontario Municipal Board process, staff have worked with the Grand River Conservation Authority, and as part of that process retained Stantec Consulting to provide advice, as they worked on the original drainage study. Extension of the purchase order is necessary because of the additional scope of this project. On motion by Mayor C. Zehr - It was resolved: "That the extension of the purchase order for consulting services to Stantec Consulting for the amount of $155,000 plus GST for work completed on the Upper Blair Creek Functional Drainage Study, as part of the current Ontario Municipal Board Appeal in the Doon South Community Plan (Phase 2), be approved and be allocated from the Development Charges Fund -Engineering Studies (Index Code 861061)." 6. DTS-0$-060 -STRATEGIC PLAN FOR THE ENVIRONMENT The Committee considered Development and Technical Services Department report DTS-08- 060, dated April 17, 2008, which provides and updated version of the City's Strategic Plan for the Environment. This report also recommends that an implementation plan be developed and that this strategic plan be reviewed on a regular basis. DTS-0$-060 -STRATEGIC PLAN FOR THE ENVIRONMENT tCONT'D) Ms. Steiner provided a detailed review of this report highlighting the major changes to the City's Strategic Plan for the Environment. She explained the public consultation process which led to changing this strategic plan from being a corporate plan to being a plan that includes the community as well as the corporation. She noted that through the consultation, residents advised that their concern about air quality was overwhelmingly the most important factor. With regard to next steps for this process, Ms. Steiner advised that following Council's decision on this matter at the May 5th Council meeting, communications to the public and staff will take place, and staff will prepare an implementation plan. This implementation plan will ensure that all projects are aligned with the priority areas of the strategic plan. On motion by Mayor C. Zehr - It was resolved: "That the updated Strategic Plan for the Environment as appended to Development and Technical Services Department report DTS-08-060 be adopted; and, That staff develop an Implementation Plan which identifies all current environmental initiatives for ongoing coordination through the Strategic Plan for the Environment and which includes a mechanism for budgeting, coordinating, monitoring and reporting on these, and all future, environmental initiatives; and further, That the Strategic Plan for the Environment be reviewed on a regular basis in order to provide timely guidance to related City policies and plans."
