ENCROACHMENT AGREEMENT REQUEST - PROPOSED
ABOVE GROUND POOL AND PORTION OF PROPOSED
DECK EXTENSION AND CHAIN LINK FENCE OVER
STORM SEWER AND SANITARY SEWER EASEMENT AT
18 OLD FOREST CRES.
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement,
satisfactory to the City Solicitor, with the property owners and any mortgagee(s) of the
property municipally known as 18 Old Forest Cres. (PIN 22464-0118 L T) and subject to an
easement registered as Instrument Number 651504, to legalize a 12' x 1', more or less,
portion of a proposed deck extension, a portion of a proposed chain link fence for a
length of approximately 50' along both side lot lines and for a length of approximately
15.2' along the rear lot line, and a 12' x 24' above ground pool, said Agreement to be
reg istered on title, if possi ble."
REPORT:
The property owners of 18 Old Forest Cres. wish to install a 12' x 24' above ground pool on their
own property. The rear of their property is subject to a 50' wide storm sewer and sanitary sewer
easement registered as Instrument Number 651504. In conjunction with the pool installation, it
is necessary to have a 5' high non-climbable fence installed around the pool to comply with
Chapter 630 (Fences) of The City of Kitchener Municipal Code. The property owners would
also like to extend the current deck to meet the pool edge. A portion of the fence will encroach
onto the easement for a length of approximately 50' along both side lot lines and for a length of
approximately 15.2' along the rear lot line. The proposed deck extension will encroach
approximately l' onto the easement for a length of approximately 12'. A drawing of the
proposed encroachments is attached.
Engineering Services has no objection to the installation of the proposed above ground
swimming pool, fence and deck extension over the easement. They have noted that the
sanitary sewer pipe is located 23' below ground and the storm sewer pipe is located 17' below
ground.
CONCLUSION:
The appropriate staff has reviewed this request and has no concerns with the location of the
proposed above ground pool and portion of deck extension and chain link fence.
