Installation of Air Conditioner Units & Satellite Dishes
RECOMMENDATION:
1. That the request of Kitchener Housing Inc. to permit the installation of air conditioner units
on the north (Joseph Street), east, and west (David Street) elevations of the property
designated under Part IV of the Ontario Heritage Act and municipally known as 25 Joseph
Street (former Victoria Public School), be approved subject to compliance with the following
criteria:
i. That only one air conditioner unit is permitted per residential dwelling unit; and,
ii. That the tenant is required to enter into an Operating Agreement with Kitchener Housing
Inc. prior to the installation of the air conditioner unit; and,
iii. That the Kitchener Housing Inc. Operating Agreement for the installation of air
conditioners include the following provisions:
• That the air conditioner unit must be professionally installed to the satisfaction of
Kitchener Housing Inc.;
• That air conditioner units must be installed on a platform supplied and constructed by
Kitchener Housing Inc.;
• That the platform on which the air conditioner is located shall be constructed of wood
and may not be physically fastened to the exterior of the building;
• That the platform will be painted to match the existing window;
• That the installation of the air conditioner unit must be inspected by Kitchener
Housing Inc. to ensure the installation and use of the air conditioner causes no
physical damage to the building or its heritage attributes;
• That the installation of air conditioner units shall be temporary, and may not be
installed prior to May 1St and must be removed by September 30th each year; and,
iv. That the permitted location of air conditioner units shall be in accordance with the
building elevation drawings attached as Appendix A to DTS -08 -068 dated May 5, 2008;
and,
V. That air conditioner units that do not meet these criteria shall be subject to Council
consideration through the formal Heritage Permit Application process under the Ontario
Heritage Act.
REPORT:
By -law Enforcement received a complaint in December 2007 regarding the installation of a
satellite dish on the east elevation of the former Victoria Public School located at 25 Joseph
___street. -Heritage- Planning staff were _contacted to determine...if___ _a._.... satellite__ dish was perm.itted._.
Staff confirmed that the property is designated under Part IV of the Ontario Heritage Act. The
designating by -law identifies the property as being of historical and architectural value with
emphasis on the north elevation (Joseph Street), east elevation, west elevation (David Street),
and the slate roof. Section 33.(1) of the Ontario Heritage Act indicates that no owner of a
designated property shall alter the property or permit the alteration of the property if the
alteration is likely to affect the property's heritage attributes unless the owner applies to the
council of the municipality and receives consent in writing to the alteration. Staff confirm that the
installation of a satellite dish is considered an alteration under the Ontario Heritage Act and
therefore the installation of a satellite dish requires the consent of Council.
A site inspection revealed that the satellite dish was installed on a wood platform located on the
east elevation. From the exterior, the wood platform appeared to hook over the edge of the
window sill with the weight of the closed window providing extra support. This installation
technique was confirmed through discussions with the property owner and a site inspection to
view the platform. The satellite dish has since been removed. However, Kitchener Housing Inc.
expressed interest in proceeding with a process to permit tenants to install satellite dishes.
In addition to the site inspection, Staff reviewed the heritage property file to understand the
rationale for the use of a wood platform. It was determined that the platform was likely used to
facilitate the temporary installation of an air conditioner unit. The minutes from the former
LACAC committee, dated June 11, 1993 indicate that Kitchener Housing Inc. requested
approval to install air conditioner units. At the meeting, the Committee made the following
resolution, which was later passed by Council on June 22, 1993,
"That Council approve in principle the request of Kitchener Housing Incorporated to install,
where applicable, window air conditioners on the exterior elevations (excluding the
courtyard) of the designated property known municipally as 25 Joseph Street west (former
Victoria Public School), subject to an architect's proposal outlining the details of the design,
installation, positioning and any other related items being submitted to L.A. C.A.C. for
consideration and approval. "
Staff have confirmed that an architect's proposal was not prepared or submitted to LACAC for
review. However, Kitchener Housing Inc. has permitted tenants to install air conditioner units
subject to the tenant entering into an operating agreement. Kitchener Housing Inc. has
acknowledged that the appropriate process was not followed. As a result, Kitchener Housing
Inc. would like to confirm the appropriate process to allow tenants to install air conditioner units.
Staff request that Council confirm the appropriate process to consider the installation of both air
conditioner units and satellite dishes. In this regard, Heritage planning staff provide the
following recommendations.
Air Conditioner Units
Staff believe that an architect's proposal is not required but rather that Kitchener Housing Inc., in
consultation with the tenants, shall meet a standard set of criteria in order to obtain approval to
install air conditioner units. A standard set of criteria was developed by Staff in consultation with
Kitchener Housing Inc. and Heritage Kitchener. The criteria include the existing Kitchener
Housing Inc. requirement for tenants to enter into an operating agreement as well as additional
criteria related to the construction, installation and location of air conditioner units. The number

elevation and the corresponding internal layout of residential units. The criteria are as follows:
i. That only one air conditioner unit is permitted per residential dwelling unit; and,

Staff recommend that no formal Heritage Permit Application is required where the installation of
an air conditioner unit meets the above criteria. The above criteria will minimize the physical and
visual impact of the installation of the air conditioner units on the heritage attributes of the
building. Where Kitchener Housing Inc. receives a request to install an air conditioner unit that
does not meet the above criteria, a formal Heritage Permit Application will be required in order
to consider the potential impact on the heritage attributes of the building.
Satellite Dishes
Unlike air conditioner units, which are more consistent in shape with windows and window
openings, and more predictable in location and orientation; the installation of satellite dishes
may impose a greater visual impact on the heritage character of the former Victoria Public
School. Further, feasible alternatives to the 'installation of satellite dishes exist (e.g. cable
television). In an effort to minimize physical and visual impact, Staff recommend that requests to
install a satellite dish on the north (Joseph Street), east, and west (David Street) elevations of
the former Victoria Public School, be subject to Council approval through the Heritage Permit
application process. Applications that request permission to install a satellite dish will be
considered on individual merit with consideration given to available alternatives as well as the
size, number, location and installation method of the satellite dish.

It is the opinion of Staff, that the installation of air conditioner units on the north (Joseph Street),
east, and west (David Street) elevation of 25 Joseph Street, in compliance with the criteria
outlined in this report, would not impair the heritage character of the Part IV designated former
Victoria Public School, and thus should not require the submission and approval of a Heritage
Permit application.
The installation of satellite dishes may detract from the character of the Part IV designation. As
a result, the request to permit the installation of satellite dishes on the north (Joseph Street),
east, and west elevation of 25 Joseph Street must be accompanied by a formal Heritage Permit
Application. Each request for a satellite dish will be considered on an individual basis so as to
ensure that the installation of the satellite dish will not detract from the heritage character of the
Part IV designated property.
