REVISED AGREEMENT FOR VICTORIA PARK ENTRANCE
FEATURE PUBLIC ART PROJECT ("THE LUGGAGE
PROJECT")
RECOMMENDATION:
That an existing agreement with artist Ernest Daetwyler for "The Luggage Project" be
further amended to include costs for extended insurance and storage costs totalling
$4,340.00; and further,
That the Mayor and Clerk be authorized to execute the amended agreement, subject to
the satisfaction of the City Solicitor.
BACKGROUND:
In April 2004 (CSD-04-084) Council endorsed the acquisition of "The Luggage Project" by
Ernest Daetwyler. The artwork was selected by a public jury and funded through the City's
Percent for Art Policy for placement in the new Victoria Park entrance area.
The artwork consists of seven white limestone sculptures depicting luggage of various eras. The
sculptures are modelled on actual luggage used by immigrants to Kitchener throughout history,
and quotations from immigrants to Kitchener comprise the tags for each piece.
Originally intended to be installed in the fall of 2004 or spring 2005, site delays made it
necessary to store the sculptures. Report CSD-05-118, approved in October 2005, made an
amendment to the original artist/City contract possible. The amendment allowed for increased
costs (insurance and storage) caused by project delays at Joseph and Gaukel Streets, to the
end of August 2006.
REPORT:
Further unanticipated delays resulted in continuing storage of the artwork throughout the period
September 2006 - June 2008. Report CSD-08-045 requests Council's consideration of a
second amendment to the artist/City contract, subject to the satisfaction of the City Solicitor. The
sculptures will be installed at the beginning of June 2008. The long awaited unveiling event will
take place on Friday, June 6 at Victoria Park.
FINANCIAL IMPLICATIONS:
Additional fees for insurance and storage are based on the rate established in 2005 with the first
contract amendment. Charged at $100 per month for 21 months, additional costs payable to the
artist total $4,340 to be drawn from Account 636024.
COMMUNICATIONS:
The City of Kitchener Public Art Working Group and Arts and Culture Advisory Group are
dedicated to supporting the City of Kitchener Percent for Art Program. Public artwork in the city
reflects the City's commitment to place-making and community development through the arts,
as identified in the Culture Plan II. This particular work of art celebrates the tradition of cultural
diversity of the City. The public at large will be invited to the June 6 unveiling ceremony. The
event will be part of an evening of celebration including the launch of the Tapestry Festival and
of the Ontario Arts Council's "Celebrate Our Artists!" weekend.
CONCLUSION:
The upcoming public art policy and program review (spring/summer 2008) will consider and
make recommendations concerning the improved administration of budget surpluses and
shortfalls.
