DTS-0$-064 - BORDEN AVENUE NORTH - ON-STREET PARKING PROHIBITION The Committee considered Development and Technical Services Department report DTS-08- 064, dated April 18, 2008, recommending a parking prohibition on a portion of Borden Avenue North. On motion by Councillor J. Gazzola - it was resolved: "That on-street parking be prohibited from January 1St to March 31St of each year on the west side of Borden Avenue North from Crescent Street to Weber Street East; and further, That the Uniform Traffic By-law be amended accordingly." 2. DTS-0$-074 - PARKING AGREEMENT WITH ROCKWAY HOLDINGS LTD - 1664 HURON ROAD The Committee considered Development and Technical Services Department report DTS-08- 074, dated May 1, 2008, recommending an agreement with Rockway Holdings Ltd. for use of their parking lot at 1664 Huron Road on June 14, 2008. On motion by Councillor J. Gazzola - it was resolved: "That the Mayor and Clerk be authorized to execute an agreement satisfactory to the City Solicitor, with Rockway Holdings Ltd. regarding permission to enter upon and use the parking lot located at 1664 Huron Road on June 14, 2008 for the purpose of operating an unpaid parking lot to serve attendees of the Grand Opening Celebration and Open House at Fire Station #7." 3. DTS-0$-073 - ADDENDUM TO DTS-0$-03$ -HERITAGE PROPERTY STANDARDS The Committee considered Development and Technical Services Department report DTS-08- 073, dated April 30, 2008, recommending a further deferral of a by-law to impose special property standards on heritage properties. This deferral will allow staff time to review and evaluate the comments received from affected property owners at the public meeting held on April 17, 2008. On motion by Councillor J. Gazzola - it was resolved: "That consideration of the recommendation made in DTS-08-038 (A By-law to Amend Chapter 665 [Property Standards] of the City of Kitchener Municipal Code, with respect to Designated Heritage Property) be deferred and referred to a future meeting of the Development and Technical Services Committee. " DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES MAY 12, 200$ - 30 - CITY OF KITCHENER 4. DTS-0$-047 - ADDENDUM TO DTS-0$-032 -ALDER STRASBURG CREEK WATERSHED STUDY AND UPPER STRASBURG CREEK WATERSHED PLAN UPDATE - and - DTS-0$-04$ - ADDENDUM TO DTS-0$-034 - UPPER STRASBURG CREEK CLASS ENVIRONMENTAL REPORT - and - DTS-0$-071 - ADDENDUM TO DTS-0$-013 -SOUTHWEST KITCHENER SUBDIVISION The Committee considered 3 Development and Technical Services Department reports this date dealing with planning and engineering matters affecting development in southwest Kitchener: DTS-08-047, dated April 25, 2008, being an addendum report to DTS-08-032 -Alder Strasburg Creek Watershed Study and Upper Strasburg Creek Watershed Plan Update; DTS-08-048, dated April 30, 2008, being afollow-up report to DTS-08-034, Upper Strasburg Creek Class Environmental Assessment; and DTS-08-071, dated May 5, 2007, being an addendum to DTS- 08-013, Southwest Kitchener -Directions Regarding Development Applications. All these matters were referred by Council, to this meeting. The following delegations were in attendance: Mr. T. Mahood, CH2MHill, the City's consultants, was in attendance to present the Environmental Assessment; Ms. B. Brown, Grand River Conservation Authority was in attendance to respond to questions from the Committee; Mr. P. Britton, MHBC Planning, was in attendance on behalf of "Area #2" property owners; Mr. I. MacNaughton, MHBC Planning, was in attendance on behalf of Mattamy Homes; Mr. P. Smith, Bousfield Inc. was in attendance on behalf of Cook Homes; and Mr. G. Scheels, GSP Group, was in attendance on behalf of RBJ Schlegel, an owner of property in "Area #3". Mr. Korah advised that since Council referred these reports to this meeting, there have been meetings with staff, representatives from the public agencies involved, the City's consultant and consultants representing property owners. Regarding the first concern of the Area #2 property owners, being gravel pit issues, Mr. Korah advised that there is clarification of these issues in the addendum report DTS-08-047, and tables 4.1 and 4.2 highlight the infiltration rates. The second concern addressed by Mr. Korah was chloride application rates, and he advised that the consultant and the various public agencies acknowledge that there needs to be different chloride rates for arterial, collector and local roads. Mr. P. Smith, Bousfield Inc. addressed the Committee advising that he has received confirmation from staff that individual owners of land can prepare storm water management plans for their own lands under the circumstances identified on page 3 of DTS-08-047. He stated that he is satisfied that all the concerns raised by him and the land owners have been resolved. Mr. T. Mahood, CH2MHill presented the Upper Strasburg Creek Class Environmental Assessment (EA) recommended in DFTS-08-048 and DTS-08-034. He noted that he third alternative, of the 4 alternatives considered through the EA process, is being recommended: "Alternative 3 -replace existing 900mm culvert with a similar sized culvert and add a high level overflow culvert(s)." It was noted that the culvert replacement is included in the Region of Waterloo Transportation Capital Budget program in 2013; however, the City's Middle Strasburg Creek sanitary sewer project, which is planned to cross Fischer-Hallman Road at the same location as the culvert, is planned for 2010, and these two projects should be undertaken at the same time. Mr. Mahood recommended that this Environmental Assessment be filed with the Ministry of the Environment for the mandatory 30 day review period as required by the Environmental Assessment Act. Mayor Zehr stated the there is a timing issue, that the downstream plan (Strasburg Creek Flood Control Class EA) may cause an amendment to this EA. If the current EA is approved and the culverts are installed, money would have been wasted. Mr. Mahood responded that the downstream EA will be completed before the culverts are installed. DTS-0$-047 - ADDENDUM TO DTS-0$-032 -ALDER STRASBURG CREEK WATERSHED STUDY AND UPPER STRASBURG CREEK WATERSHED PLAN UPDATE tCONT'D) - and - DTS-0$-04$ - ADDENDUM TO DTS-0$-034 - UPPER STRASBURG CREEK CLASS ENVIRONMENTAL REPORT tCONT'D) - and - DTS-0$-071 - ADDENDUM TO DTS-0$-013 -SOUTHWEST KITCHENER SUBDIVISION tCONT'D) He also advised that there are other matters which should be taken into consideration, such as timing for habitat protection, and only the narrow focus of the Regional flood control may be amended. He did confirm that the outcome of the downstream EA may change the recommendation in this current EA but only with respect to the culvert. Councillor Vrbanovic questioned why the two EA's were not completed at the same time. Mr. Mahood responded that this EA for the culvert itself was not something that needed to be linked to the other document. He stated that they tried to minimize the extent of this EA to make it simple, and that to tie the two EA's together would make it difficult to resolve, as the other EA includes storm water management. This EA is a stand-alone document. Councillor Vrbanovic noted that the culvert is not in the Region's capital forecast until 2013, and although they may bring it forward to 2010, there is no commitment at this tome to do so. He also noted that the weir EA should be completed before 2010. He questioned that if his order of these matters is correct, and nothing is to happen until 2010, why is it necessary to file this Ea at this time. Mr. Mahood responded that there are a number of recommendations in this EA document, such as matters concerning water quality and stream habitat. The 30 day filing period allows the public to bring issues forward, and they can be dealt with at this time instead of waiting for the future filing date for the downstream EA. Councillor Vrbanovic stated that the City tries to work through issues up front, and Mr. Mahood gives the impression that he is expecting other issues will be presented during the filing period. Mr. Mahood responded that he is not expecting any new issues to come forward, but he would like to file this document because the public expects closure. Councillor Lorentz questioned the existing problems with current flood control, and Mr. Mahood stated that 335m is to be achieved and there can be a 338m Regional flood line. The Grand River Conservation Authority (GRCA) has advised that there are currently three or four homes that would be flooded at a 338m flood line. Councillor Lorentz then stated that there is a lack of developable land in this area and the west side is Kitchener's area for new development. Most of the gravel pits in this area are coming to the end of their production, and are ready to be developed. He questioned whether the size of culvert chosen takes into consideration that this land will be developed. Mr. Mahood stated that this is a unique area and the hummocky terrain allows for infiltration. Consideration was given to the range of opportunities and various scenarios were modelled. He noted that the overflow culverts will be at a higher elevation than the existing culvert. Mayor Zehr questioned whether the portion of the EA regarding the culvert could be separated from the rest of the EA so that the remainder of the EA could be filed with the Ministry. Mr. Mahood noted that the rest of this EA recognizes that the down stream EA will handle flood control differently. He stated that it would be difficult to separate the two parts of the EA for filing purposes. Mr. P. Britton submitted a memorandum to the Committee members, this date. DTS-t)$-047 - ADDENDUM TO DTS-t)$-032 -ALDER STRASBURG CREEK WATERSHED STUDY AND UPPER STRASBURG CREEK WATERSHED PLAN UPDATE tCONT'D) - and - DTS-0$-04$ - ADDENDUM TO DTS-t)$-034 -UPPER STRASBURG CREEK CLASS ENVIRONMENTAL REPORT tCONT'D) - and - DTS-t)$-071 - ADDENDUM TO DTS-t)$-013 -SOUTHWEST KITCHENER SUBDIVISION tCONT'D) "1) That the Upper Strasburg Creek Environmental Assessment Report be deferred pending consideration of the Class Environmental Assessment Study for the Strasburg Creek flood control structure; and 2) That Council acknowledge lands known as the Westside are not intended for Business Park purposes and direct continued processing of Municipal Plan Amendments as primarily mixed use residential communities (with some employment opportunities) with focus on implementing environmentally sustainable principles and a high level of urban design." Mr. Britton thanked staff and the City's consultant for meetings conducted to address the issues he previously raised at this Committee's meeting in March. He advised that the issues outlined in his memorandum still need to be resolved. He noted that the EA before the Committee this date is unique to Areas #2 & #3 only. He advised that there is an approved watershed study, and that study contemplates an on-line weir, and approved storm water management solutions. He stated that the culvert moves the solution from that which has already been approved. Further, the City's Development Charge By-law has established rates based on the installation of this weir, and the City is collecting Development Charges for this purpose. He stated that this EA transfers the responsibility to the Area #2 lands. He advised that the weir EA and the size of the culvert are linked. With respect to timing issues, Mr. Britton advised that installation of the culverts is anticipated for 2013 or at the earliest 2010; therefore, there is time to study the weir as a solution, and from a process point of view, it avoids the need for an addendum EA. Mr. Britton stated that he is not asking this Committee to increase the culvert but to study the weir. If this is not done, the Area #2 land owners would have no choice but to object to this EA, which they do not want to have to do. Mr. Britton then spoke to his second recommendation dealing with the Business Park designation that was previously recommended for this land. He spoke of his clients' current obligations for rehabilitating their gravel pits, and asked that the City confirm that there will not be a Business Park designation for the west side lands, but that the land will be designated for residential use. Mayor Zehr questioned why Mr. Britton wants this Committee to defer a decision on the EA, but not on the watershed study. Mr. Britton responded that sub-watershed study breaks this area into parts and Areas #1 and #4 are entirely separate from Areas #2 and #3. Mayor Zehr questioned the timing of the next phase, should this Committee decide to defer either or both of these engineering reports. Mr. Murphy advised there are linkages between the reports but the culvert EA could be treated separately. He stated that if the EA is approved, there will be a 30 day filing period during which time residents can put forward comments; as this is a public process, and concerns can be addressed at that time. When questioned by the Committee, Mr. Britton advised that he is in agreement with the staff recommendation in DTS-08-047, but not with the recommendation in DTS-08-048 because of the downstream EA. Councillor Vrbanovic questioned whether there would be any negative implications in deferring a decision on the sub-watershed study if a decision is deferred on the EA because of Mr. Britton's DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES MAY 12, 200$ - 33 - CITY OF KITCHENER 4. Mr. Murphy stated that the EA is a separate document; further, there are linkages to other project: the Huron Road widening and EA will start soon and will conclude in 1-2 years. Mr. Murphy stated that deferring a decision on this EA causes him concern because the technical and scientific work has been done and in order to use this work the EA should be filed as soon as possible. Councillor Vrbanovic noted that the timeline for the downstream EA is 1-2 years which brings us close to 2010, which is the year staff wants the Region to install the culvert. These actions almost predetermine an outcome as to what will happen with the downstream EA, or we will have throw-away costs. Mr. Murphy responded that the timing is related to the construction, through the planning process, for infrastructure, as it ties in with widening Huron Road. Staff will co-ordinate the work required by this EA through the budget process. In response to questions from Councillor Lorentz, Mr. Britton advised that a lot of work has already been done on the weir EA, and he does not understand why both EA's were not done together. He expected that the maximum time for the deferral, to allow completion of the weir EA, will be 1-2 years. Mr. P. Smith addressed the Committee advising he represents Cook Homes who owns land in Area #3. He stated that he supports the staff recommendations in both DTS-08-047 and DTS- 08-048. Mr. Smith advised that his clients participated throughout the 5 year process, and they want to move forward and finalize this process. He stated that these two reports are linked, in that the storm water management recommendation relies in part on the Regional flood line in the EA report. He noted that both of these documents have been approved by the GRCA. He stated that if there is no culvert then they can not undertake the storm water management. Further, this is a solution that they know will work. Approval of these reports will allow for finality and it still leaves the door open for a better solution if there is one. Councillor Vrbanovic questioned whether both recommendations should be deferred if this Committee has concerns about the EA and Mr. Smith responded that the two documents are linked, and if one is deferred, they should both be deferred. Councillor Lorentz questioned Mr. Smith as to whether Cook Homes is willing to give up some of their land for storm water management ponds. Mr. Smith responded that they are prepared to do so in conjunction with neighbouring property owners. He also advised that, having participated in this process over the last two years, he is satisfied that there are no environmental issues. Mr. Mahood advised that determination of ground water infiltration rates held up the completion of this EA because the Region had to do new modelling. Storm water management in the Upper Strasburg Creek is essential in order for the problem not to shift down stream. Also there is hummocky terrain and it is essential to maintain infiltration rates so that the ground water aquifer is maintained. Mr. L MacNaughton addressed the Committee on behalf of his clients Mattamy Homes, in support of Development and Technical Services Department report DTS-08-071. He offered his appreciation to staff for recognizing their previous commitment. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES MAY 12, 200$ - 34 - CITY OF KITCHENER 4. DTS-A$-047 - ADDENDUM TO DTS-A$-032 -ALDER STRASBURG CREEK WATERSHED STUDY AND UPPER STRASBURG CREEK WATERSHED PLAN UPDATE tCONT'D) - and - DTS-0$-04$ - ADDENDUM TO DTS-A$-034 -UPPER STRASBURG CREEK CLASS ENVIRONMENTAL REPORT tCONT'D) - and - DTS-A$-071 - ADDENDUM TO DTS-A$-013 -SOUTHWEST KITCHENER SUBDIVISION tCONT'D) Mr. G. Scheels spoke on behalf of his client RBJ Schlegel, who owns land in Area #3, in support of the staff recommendations contain in the reports DTS-08-047 and DTS-08-048. He also advised that he is in support of Mr. Smith's position on these matters. He stated that the sub- watershed study lays out a strategy for storm water management, and the EA provides a workable solution for the culvert. Although the weir EA may make changes to the culvert, the possibility for such a change is provided for in the current EA. He asked that this Committee adopt the recommendations in these two staff reports. Mayor Zehr noted that there are linkages between these two staff reports, and earlier in the meeting he had thought to recommend that consideration of the recommendations be deferred. However, since then, Mr. Mahood has advised that any changes to this EA resulting from the outcome of the downstream EA will be an enhancement to this EA, so he is prepared to move the recommendations in these staff reports. Councillor Lorentz put forward a motion to defer consideration of these staff recommendations until the Council meeting of May 20th, as he is not convinced that approval of this EA is appropriate at this time. Mayor Zehr stated that he could support this deferral provided that it does not go beyond May 20th On motion by Councillor G. Lorentz - it was resolved: That consideration of the following recommendation contained in Development and Technical Services Department report DTS-08-047 be referred to the Council meeting of Tuesday Mav 20.2008: "That the Alder Creek Watershed Study and Upper Strasburg Subwatershed Plan Update, prepared by CH2MHill and North-South Environmental Inc., dated January, 2008 be adopted and approved in its entirety including the proposed clarification with regards to the form of gravel pits and chloride application rates as set out in Development and Technical Services Department report DTS 08-047." On motion by Councillor G. Lorentz - it was resolved: That consideration of the following recommendation contained in Development and Technical Services Department report DTS-08-048 be referred to the Council meeting of Tuesdav Mav 20, 2008: "That the Upper Strasburg Creek Class Environmental Assessment Report prepared by CH2MHill and North-South Environmental Inc., dated January 2008 be filed with the Ministry of Environment for the mandatory thirty (30) day review period as required by the Environmental Assessment Act." Councillor Galloway recommended that consideration of DTS-08-071 and DTS-08-013 also be deferred to the Council meeting of May 20, 2008, as they are linked to the other two reports. DTS-A$-047 - ADDENDUM TO DTS-A$-032 -ALDER STRASBURG CREEK WATERSHED STUDY AND UPPER STRASBURG CREEK WATERSHED PLAN UPDATE tCONT'D) - and - DTS-0$-04$ - ADDENDUM TO DTS-A$-034 -UPPER STRASBURG CREEK CLASS ENVIRONMENTAL REPORT tCONT'D) - and - DTS-A$-071 - ADDENDUM TO DTS-A$-013 -SOUTHWEST KITCHENER SUBDIVISION tCONT'D) Mr. Willmer addressed the Committee noting that these are the reports referred to and supported by Mr. MacNaughton. Mr. Willmer reviewed DTS-08-013 noting that consideration of the first 4 recommendations in that report had been deferred at the March 13th meeting and the 5th recommendation, as amended, was adopted by Council. Mr. Willmer then referred to an extract of the March 5, 2007, Development and Technical Services Committee minutes, attached to the staff report, noting that since deferral of DTS-08- 013, it has been brought to his attention a commitment was made on March 5, 2007, to process applications which are complete, and it is staff's intention to process complete applications as outlined in DTS-08-071. He noted that the commitment of March 2007 was to process complete applications received in 2007, but questioned what to do with complete applications received in 2008, noting they could also be processed by staff or brought to this Committee for direction regarding processing. Mr. Willmer amended recommendation #1 in DTS-08-013 to state that the lands known as 'west side' lands are "on the south side of Bleams Road between Trussler Road and Fischer-Hallman Road". He also amended recommendation #2 in this report to remove "all" after the word "That" and change it to "That approval of any development applications..." He also removed the words "reviewed and" at the end of recommendation #2. Councillor Galloway questioned how these proposals will affect staff resources in terms of completing a Growth Management Strategy. Mr. Willmer responded that the Growth Management Strategy will be completed before these planning applications are finally considered. On motion by Councillor K. Galloway - it was resolved: That consideration of the following recommendation contained in Development and Technical Services Department report DTS-08-013, as amended at the Development and Technical Services Committee meeting of May 12, 2008, be referred to the Council meeting of Tuesday Mav 20, 2008: "That the `Business Park' land use designation for the lands known as the `West Side', being the south side of Bleams Road between Trussler Road and Fischer- Hallman Road, continue to be held in abeyance and that new urban designations be determined, to include residential and a mixture of land uses (including employment opportunities), afocus on implementing environmental sustainability principles and a high level of urban design be explored, along with the preparation of Community or Master Plans at the appropriate time recommended by the Kitchener Growth Management Strategy; and, That approval of any development applications for the lands known as the `West Side' (Conestoga Parkway/Trussler/Fischer Hallman/Huron), including MP04/03/B/BS, MP05/03/T/DR, MP05/04/H/BS, the subdivision and zone change applications recently submitted to the northwest of Fischer Hallman/Huron Road intersection and any new applications in the subject area wait until after the recommendations of the Kitchener Growth Management Strategy are known and DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES MAY 12, 200$ - 36 - CITY OF KITCHENER 4. DTS-t)8-047 - ADDENDUM TO DTS-t)8-032 -ALDER STRASBURG CREEK WATERSHED STUDY AND UPPER STRASBURG CREEK WATERSHED PLAN UPDATE tCONT'D) - and - DTS-08-048 - ADDENDUM TO DTS-t)8-034 -UPPER STRASBURG CREEK CLASS ENVIRONMENTAL REPORT tCONT'D) - and - DTS-t)8-071 - ADDENDUM TO DTS-t)8-013 -SOUTHWEST KITCHENER SUBDIVISION tCONT'D) the timing for recommendation of these applications be re-evaluated thereafter; and, That staff coordinate transportation master planning for the southwest portion of Kitchener and vision and design principles for the Fischer-Hallman Corridor from New Dundee Road to Ottawa Street with the Region of Waterloo and any affected `West Side' land owners; and, That the update contained within Development and Technical Services Department report DTS-08-013 on the Kitchener Growth Management Strategy (KGMS) be received for information and a report on the KGMS be targeted by the end of 2008."; and further, That consideration of the following recommendation contained in Development and Technical Services Department report DTS-08-071, be referred to the Council meeting of Tuesday Mav 20, 2008: "That Development and Technical Services Department report DTS-08-071 be received for information purposes, regarding the circulation of plans of subdivision and rezoning applications for Tru-Villa Incorporated & 2040769 Ontario Limited (Mattamy Homes), and Karen and Gordon Doehn, for land west of Fischer- Hallman Road and north of Huron Road." 5. DTS-t)8-066 - AMENDMENT TO PURCHASE ORDER FOR CONSULTING SERVICES - CLASS ENVIRONMENTAL ASSESSMENT STUDY - STRASBURG FLOOD CONTROL STRUCTURE The Committee considered Development and Technical Services Department report DTS-08- 066, dated April 23, 2008, recommending extension of the purchase order for consulting fees for the Class Environmental Assessment Study for the Strasburg Flood Control Structure. The City's consultant for this study is Stantec Consulting who was awarded this work by Council in 2003. Mr. B. Korah explained the report. On motion by Councillor K. Galloway - it was resolved: "That the extension of the purchase order for consulting services to Stantec Consulting Limited for the additional amount of $65,000 plus GST to complete the Class Environmental Assessment Study for the Strasburg Creek Flood Control Structure be approved with the funds to be allocated from the Development Charges Project, Middle/South Strasburg Creek Water Course, Index Code 855221." 6. PRESENTATION - RAPID TRANSIT STATION AREA PLAN PILOT PROJECT The Committee was in receipt of Region of Waterloo report P-08-040, dated April 1, 2008, titled "Reurbanization Working Group -Station Area Plan Pilot Project Update". DTS-0$-05$ - DEMOLITION CONTROL APPLICATION - DC 0$l02IFISR The Committee considered Development and Technical Services Department report DTS-08- 058, dated April 29, 2008, recommending approval of Demolition Control Application DC08/02/F/SR for 770 Frederick Street, on the condition that the owner obtains site plan approval for the proposed 8 unit multiple dwelling. On motion by Mayor C. Zehr - it was resolved: "That Demolition Control Application DC 08/02/F/SR requesting permission to demolish a single family dwelling located at 770 Frederick Street, owned by Stephen Patrick McElhone, legally described as Plan 764 Part Lot 43 RP58R7302 Part 1, be approved in principle, subject to the following condition: 1) That the owner obtains site plan approval for the proposed eight (8)-unit multiple dwelling; and further, That upon satisfaction of Condition 1, the Chief Building Official may authorize and issue a demolition permit under Section 33(6) of the Planning Act. The demolition permit will be subject to the following condition: `That in the event that construction of the 8-unit multiple dwelling is not substantially complete within 2-years of the date of issuance of the demolition permit, the City Clerk may enter on the collector's roll, to be collected in like manner as municipal taxes, $20,000 for each dwelling unit contained in the residential property in respect of which the demolition permit is issued and such sum shall, until the payment thereof, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued.' $. On motion by Mayor C. Zehr - it was resolved: "That Demolition Control Application DC 08/01/c/bb requesting permission to demolish one single detached dwelling located at 103 Courtland Ave. E., owned by A. & F. Greenfield Homes Ltd., legally described as Pt. Lot 3, Registered Plan 419, be approved unconditionally." 9. DTS-0$-065 - DEMOLITION CONTROL APPLICATION - DC 0$l03IAIAP - 196 AHRENS STREET WEST The Committee considered Development and Technical Services Department report DTS-08- 65, dated May 1, 2008, recommending unconditional approval of Demolition Control Application DC/08/03/A/AP, for 196 Ahrens Street West. On motion by Mayor C. Zehr - it was resolved: "That Demolition Control Application DC08/03/A/AP requesting permission to demolish one single detached dwelling located at 196 Ahrens Street West, owned by Kelly Robinson and Vera Petrovic, legally described as Lot 5, Plan 75 be approved unconditionally." DTS-0$-069 - KITCHENER CYCLING ADVISORY COMMITTEE - TERMS OF REFERENCE The Committee considered Development and Technical Services Department report DTS-08- 069, dated April 29, 2008, recommending a term of reference for, and establishment of the City of Kitchener Cycling Committee. In response to questions from the Committee regarding the timing of appointments to the Cycling Committee, Mr. Schirm recommended that the members be appointed for the standard 2 years plus the period from September to November 30, 2008. He noted that he has discussed the matter of soliciting members for the Cycling Committee with the City Clerk, and it will take some time to find appropriate members. Councillor Vrbanovic offered his support for the proposed terms of reference for the Kitchener Cycling Advisory Committee, and recommended that Mr. Schirm speak to the City Clerk about the current advisory committee review process. On motion by Councillor B. Vrbanovic - it was resolved: "That the City of Kitchener Cycling Advisory Committee be instituted effective September 2008; and, That the Terms of Reference for the City of Kitchener Cycling Advisory Committee, attached to Development and Technical Services Department report DTS-08-069 be adopted; and further, That a Cycling Advisory Committee Account be established with $400.00 for meeting expenses in 2008." 11.
