HOPE ST RECOMMENDATION: For information only. BACKGROUND: On May 5, 2008 Council passed a resolution that the recommendation contained in report CRPS-08-066 concerning an Encroachment Agreement to legalize an existing fence at 76 Mt. Hope St. encroaching onto the York St. road allowance be deferred to allow the property owner to have further discussions with City staff to clarify issues concerning the height and setback of the existing fence. REPORT: The owners of 76 Mt. Hope St. submitted a request for an encroachment agreement with the City in order to legalize an existing fence. The appropriate staff and outside utility companies have reviewed this request and have no concerns with entering into an encroachment agreement provided a minor variance approval for an exemption from Chapter 630 (Fences} of the City of Kitchener Municipal Code is obtained and the 6' high fence located in the driveway visibility triangle is brought into compliance with Chapters 630 and 842 of The City of Kitchener Municipal Code. The current owner has subsequently been contacted by Legal Services and the owner advised that adjustments were made to the fence in order to comply. Staff has conducted a site inspection and has confirmed that the fence abutting the York St. driveway has been adjusted and sight lines are satisfactory.
