Gosse, Director of Legislated Services/City Clerk Patricia Harris, Manager of Licensing 6 Date of Report: June 17, 2008 Report No.: Subject: CRPS-08-114 REQUEST FOR EXEMPTION FROM BY-LAW 2008-95 (GUNS) RECOMMENDATION: That 1581688 Ontario Inc. operating as Flag Raiders Indoor Paintball, 259 Gage Avenue and Conquest Paintball Inc., 69 Agnes Street be granted an exemption from By-law 2008-95 (Guns) to permit paint ball guns and air soft guns to be discharged at their respective business addresses. BACKGROUND: On May 20, 2008 City Council passed By-law 2008-95 with respect to Guns in the City of Kitchener. The by-law does not permit the discharge of any guns within the City, except for the uses described in Section 5 of the By-law. Paintball operators are not one of the exceptions in Section 5. It does, however, provide for the opportunity for a person to make application to Council for an exemption to the by-law by providing certain information to the Manager of Licensing, including: · The nature of the proposed exemption · A police clearance letter for the person seeking the exemption · The location of the premises to be used and · The measures to be taken to prevent accidents or damage to persons or property REPORT: The Manager of Licensing has received Applications for Gun Exemption from Flag Raiders Indoor Paintball, 259 Gage Avenue and Conquest Paintball Inc., 69 Agnes Street requesting that they be granted an exemption from By-law 2008-95 (Guns) to permit them to continue to discharge paintball guns in their establishments. They have provided the Manager with all the relevant information with respect to the requirements of the by-law and everything is in order. Both businesses have held City of Kitchener business licenses for several years and have been operating for many years with no complaints received by the City. In addition to the Police Clearance letters that were required, the Chief of Police was contacted and expressed no concerns with either operation. Both businesses have also provided evidence that they have extensive safety precautions in place and all staff have had extensive training in order to ensure the safety and well being of all participants.
