Declare Portions of Unnamed Lane north of Bedford Road
between Borden and Ottawa Streets Surplus for the creation
of Easements and Mutual Right-of-ways and authorize the
subsequent conveyance to the respective abutting land
owners
RECOMMENDATION:
"That the unnamed lane running North of Bedford Road between Borden Avenue and Ottawa
Street S., be declared surplus to the City's needs and portions of the lane be conveyed to the
respective abutting property owners; and that the required easements for Bell Telephone,
Rogers Cable, and any required mutual right-of-ways be granted prior to any conveyance to the
respective abutting land owners, with all costs associated with the closure and conveyance
being the responsibility of the respective property owners on a proportionate basis; and further,
That the Mayor and Clerk be authorized to execute the necessary documentation to effect
these transactions, said documentation to be to the satisfaction of the City Solicitor."

BACKGROUND:
Council passed a resolution on April 22, 2002 to close the unnamed lane between Ottawa
Street South and Borden Avenue South and supported in principle the conveyance of portions
of the lane amongst the adjacent property owners at the price of $2.00 per square foot. The
respective property owners are responsible on a proportionate basis for all of the costs related

to the closure and conveyance of the lane. There are easements required on part of the lane
and some adjacent property owners require mutual right-of-ways over part of the lane.
REPORT:
It is a required formality for the City to declare the lane surplus in order to allow the registration
of the easements and rights-of-way and then convey the portions of lane to the respective
adjacent property owners.
FINANCIAL IMPLICATIONS:
The financial implications would be nominal as all disbursements associated with the closure
and conveyance of the lane would be the responsibility of the respective property owners.

CONCLUSION:
Staff recommends that the lane be declared surplus, easements and rights of way be registered
on the respective parts of the lane and the lane be conveyed to the respective adjacent property
owners.
