ENCROACHMENT AGREEMENT REQUEST - PROPOSED
CITY SIDEWALK AT 30 SHAFTSBURY DR.
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement,
satisfactory to the City Solicitor, with the owner of the property municipally known as 30
Shaftsbury Dr. (PIN 22547-0118), to legalize the proposed City owned sidewalk which
extends 34.455m, more or less, along the Ebydale Dr. frontage to a depth of
approximately 1.5m, more or less, together with the required .300m offset limit, onto 30
Shaftsbury Dr."
REPORT:
The owner of 30 Shaftsbury Dr. has submitted a site plan application. A condition of site plan
approval is the provision of a sidewalk, however, due to the configuration of Ebydale Dr., a
portion of the city sidewalk is required to be located on 30 Shaftsbury Dr. The sidewalk
extends approximately 21.172m along the Ebydale Dr. frontage to a depth of approximately
1 .5m together with the required .300m offset limit which makes the total length of the
encroachment approximately 34.455m.
It is necessary to enter into an encroachment agreement with the owner of 30 Shaftsbury Dr. in
order for the City to legalize its proposed sidewalk.
FINANCIAL IMPLICATIONS:

CONCLUSION:
The appropriate staff has reviewed this request and has no concerns with entering into an
encroachment agreement with the property owner of 30 Shaftsbury Dr. for the purpose of
legalizing the portion of the City sidewalk on private property.
