ENCROACHMENT AGREEMENT REQUEST - PROPOSED
PARKING AT 300 JOSEPH SCHOERG CRES. ON CITY'S
ROAD ALLOWANCE
RECOMMENDATION:
"That subject to obtaining all necessary staff approvals, the Mayor and Clerk be
authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor,
with the property owner(s) of the property municipally known as 300 Joseph Schoerg
Cres. (PIN 22733-0023), to legalize a portion of the parking located on the Joseph
Schoerg Cres. road allowance for a depth of approximately 1.5m, more or less, for a
length of approximately 9m, more or less."
REPORT:
The current owner of 300 Joseph Schoerg Cres. has requested and received Committee of
Adjustment approval to locate 3 off-street parking spaces in the front yard in front of the drive
shed. A portion of the parking spaces will encroach approximately 1.5m onto the Joseph
Schoerg Cres. road allowance for a length of approximately 9m, more or less. The parking area
will be covered with black asphalt with a soldier course of tumbled paving stone.
The request has been circulated to staff, including Heritage staff as this is a Part IV designated
heritage property. The replies received from staff to date support the proposed encroachment,
however, a couple of replies are outstanding. This request has also been circulated to all
outside utilities companies that may have current or future utilities located in the City's road
allowance. No concerns from these companies have been identified.
CONCLUSION:
The outside utility companies and most of the appropriate staff have reviewed this request and
have no concerns with entering into an encroachment agreement with the property owner(s) of
300 Joseph Schoerg Cres. for the purpose of allowing parking on the City's road allowance.
