EXEMPTION TO CHAPTER 450 (NOISE) - THE BEAT
ROCKS THE BLOCK
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to
"The Beat" radio station for "The Beat Rocks the Block" event to be held on July 26, 2008,
between the hours of 2:00 P.M. and 11 :00 P.M..
BACKGROUND:
The Beat is planning to hold its annual "Beat That Rocks the Block" event on Saturday July 26th.
This event will involve a series of live bands performing on an outdoor stage setup in the
Forsyth parking lot. There will be higher than normal noise levels associated with this event.
Thus, The Beat is requesting an exemption from Chapter 450 (Noise).
REPORT:
Staff report that there were noise complaints registered in relation to this event last year. Those
who registered the complaints were informed that a noise exemption had been granted.
In order to address the concerns that were raised last year, staff have discussed the event with
Mr. Darryl Moore who has been hired to coordinate the event on behalf of The Beat. Mr. Moore
has been involved in several downtown music events in the past.
Mr. Moore advises that he has full control over all facets of the event this year, unlike previous
years, which helps in responding to concerns that may arise. Staff have received an assurance
that the music will end promptly at 11 PM, and the contracts for all performing bands contain a
clause relating to the 11 PM noise curfew.
Mr. Moore also advises that certain modifications to the stage and sound system will be made to
help reduce the effect of noise traveling off-site. In addition, he will be the designated on-site
contact and will be in direct contact with the Noise Enforcement Officers and assures staff that
he will work with them to respond to noise concerns that may arise.
FINANCIAL IMPLICATIONS:
None identified at this time.

CONCLUSION:
Based on the circumstances surrounding this event, and the plans being coordinated to help
mitigate noise concerns, the By-law Enforcement Division does not object to this request for an
exemption.
