RECOMMENDATION: "That, subject to obtaining all necessary staff approvals, the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the owner(s) of the property municipally known as 24 Gaukel St. (PIN 22427-0078), to legalize the existing City planters and plantings which extend onto 24 Gaukel St." REPORT: As a result of the Gaukel St./Joseph St. reconstruction project, some decorative planters containing trees were placed on private property. The owner of 24 Gaukel St. is requesting the City to enter into an encroachment agreement with the owner for the City planters located on the subject property. The smaller planter facing Gaukel St. measures approximately 3.11 m x 1.95m, the larger planter facing Gaukel St. measures approximately 7.20m (longest portion of planter) x 1.95m and the planter facing Charles St. measures 6.2m (longest portion of planter) x 1.35m. A plan illustrating the location of the planters is attached as Schedule "A". It is necessary to enter into an encroachment agreement with the owner of 24 Gaukel St. in order for the City to legalize the location of its existing planters containing trees. The request is currently being reviewed by City staff, however, we would like to have approval in place for the encroachment agreement for such time as all necessary staff comments have been received so there be no delays in waiting for approval from Council due to the upcoming summer schedule. FINANCIAL IMPLICATIONS: N/A - 2 - CONCLUSION: Once all appropriate staff has reviewed and provided comments for the encroachment request, it would be in order to authorize the execution of an encroachment agreement with the owner(s) of 24 Gaukel St. JENNIFER SHERYER Assistant City Solicitor JS:sh Attach.
