McCrea Assistant City Solicitor Ward 3 Ward(s) Involved: Date of Report: Report No.: Subject: June 23, 2008 CRPS 08-127 PROPOSED LAND EXCHANGE BETWEEN CITY OF KITCHENER AND JHS PROPERTIES INC., AND PROPOSED LAND EXCHANGE BETWEEN CITY OF KITCHENER AND GRAND RIVER CONSERVATION AUTHORITY (PIONEER RIDGE) RECOMMENDATION: That the Mayor and Clerk be authorized to execute an amendment to the land exchange agreement with JHS Properties Inc., dated September 18, 2007, in respect of a portion of the Pioneer Ridge lands, satisfactory to the City Solicitor. That the Mayor and Clerk be authorized to execute an agreement of purchase and sale with the Grand River Conservation Authority, and all other required documentation to complete the transactions on terms and conditions satisfactory to the City Solicitor, to facilitate a land exchange with JHS Properties Inc. that will result in the conveyance to the City of Kitchener of a portion of the Pioneer Ridge lands on which the Schoerg Barn foundation is located and the conveyance of abutting flood plain lands to the Grand River Conservation Authority. The purchase monies, transfer costs and associated disbursements are to be allocated from the Asset Management Reserve Fund. BACKGROUND: The City of Kitchener and JHS Properties Inc. entered into a Land Exchange Agreement on September 18, 2007 to effect a land exchange that will result in the conveyance to the City of Kitchener of the portion of the Pioneer Ridge lands on which the Schoerg Barn Foundation is located and the abutting flood plain lands. REPORT: Since the execution of the Land Exchange Agreement with JHS Properties Inc. on September 18, 2007, draft plan approval of the JHS Properties Inc. plan of subdivision for adjacent Pioneer Tower lands was granted by the Ontario Municipal Board. Given the passage of time it is in order to execute an amendment to the Land Exchange Agreement to provide for the extension of certain time frames including the date of completion, and to delete clauses requiring works to be done as the works have been completed.. City staff have also met with staff of the Grand River Conservation Authority and have confirmed their agreement in principle to the transfer to the City of a parcel of land adjacent to Deer Ridge Court in exchange for the flood plain lands to be acquired from JHS Properties Inc. and a cash payment as determined through fair market value appraisals of the subject lands. CONCLUSION: The City of Kitchener, JHS Properties Inc. and the Grand River Conservation Authority are all now in a position to proceed and complete the proposed land exchanges. Fiona M.
