CONSTRUCTION -WATERLOO CATHOLIC DISTRICT
SCHOOL BOARD PROPERTY EXCHANGE
RECOMMENDATIONS:
That a portion of City owned lands adjacent to St. Mary's Secondary School and the
future extension of Block Line Road, in the City of Kitchener, comprising approximately
3,120 square metres and described as Parts 15 and 16 on Plan 58R-16139, be declared
surplus to the City's needs; and
That Council direct Legal Services and Transportation Planning staff to initiate steps to
exchange land with the Waterloo Catholic District School Board to accommodate
construction of the extension of Hanson Avenue (Lennox Lewis Way}; and
That the Mayor and Clerk be authorized to execute a Land Exchange Agreement with the
Waterloo Catholic District School Board wherein Parts 15 and 16 on Plan 58R-16139 be
conveyed to the School Board in exchange for Parts 5 to 10 inclusive on Plan 58R-16139,
comprising approximately 3,465 square metres, to facilitate the construction of the
extension of Hanson Avenue (Lennox Lewis Way}, on the terms and conditions set out in
report DTS-08-104, to the satisfaction of the City Solicitor; and
That the Mayor and Clerk be authorized to execute any documentation in this regard
required by and to the satisfaction of the City Solicitor; and
That the Mayor and Clerk be authorized to enter into an Agreement between the City and
Drewlo Holdings Inc. to provide the City with access to lands owned by Drewlo holdings
for the purpose of conducting an archeological survey, on terms and conditions
satisfactory to the City Solicitor.
REPORT:
Land Exchanae -Waterloo Catholic District School Board
On December 19, 2007 Council approved the construction of the extension of Hanson Avenue
(Lennox Lewis Way} from its present terminus, east of Hayward Avenue, to the future extension
of Block Line Road. As determined through the City of Kitchener's Twin Pad Arena
Neighbourhood Connectivity Study, the construction of the roadway extension is required to
address servicing requirements for the City's new Twin Pad Arena, as well as to improve access
to this arena, St Mary's High School, and the area in general. On June 9, 2008, Council
awarded the Tender for this project and construction of the road is scheduled to begin near the
end of June. Additional lands, being Parts 5 to 10 inclusive on Plan 58R-16139, comprising
approximately 3,465 square metres are required from the adjacent school property to
accommodate construction of the road. The Waterloo Catholic District School Board has
agreed to convey these lands to the City in exchange for Parts 15 and 16 on Plan 58R-16139,
comprising approximately 3,120 square metres. Included in this land exchange are the
conditions that Parts 15 and 16 will be graded and filled to the satisfaction of the Waterloo
Catholic District School Board, the internal roadway will be modified as agreed upon by City and
School Board staff, and that the City will salvage existing lighting for the use by the School
Board.
Prior to conveying Parts 15 and 16 to the School Board it is necessary that this parcel of land be
declared surplus to the City's needs. Parts 15 and 16 are located between St. Mary's
Secondary School and the future extension of Block Line Road as shown on the attached plan.
No long-term use has been identified by City staff for this parcel. In exchange, the School
Board will transfer to the City the lands required for the construction of Hanson Avenue (Lennox
Lewis Way) extension, being Parts 5 to 10 on Plan 58R-16139. An appraisal of the market
value is not required since the land is being conveyed to a School Board, pursuant to Schedule
A to Chapter 177 of The City of Kitchener Municipal Code respecting the Sale -Real Property.
This land exchange is required to initiate the construction of this roadway extension.
Accordingly, an immediate construction start is required in order to meet the servicing
requirements of the new Twin Pad Arena, scheduled for its official opening in September, 2008..
Drewlo Holdings Inc. -Property Access
The construction of the extension of Block Line Road from its current northerly terminus to
intersect with the extension of Hanson Avenue (Lennox Lewis Way), through to Courtland
Avenue, is scheduled for 2009. Land to facilitate the construction of this road will be conveyed
to the City by Drewlo Holdings Inc. as a condition of Subdivision Application 30T-86035. In
preparation for this construction, the City requires access to the land currently owned by Drewlo
Holdings for the purpose of conducting a required archeological survey. An Agreement
between the City and Drewlo Holdings to permit access to this land is required for this purpose.
A plan outlining the location of the Parts for the land exchange and the lands owned by Drewlo
Holdings for which the City requires access is attached.
FINANCIAL IMPLICATIONS:
The lands being exchanged have been valued by Peter Benninger Realty as follows:
Parts 5 to 10 (from School Board to City) - $278,000
Parts 15 & 16 (from City to School Board) - $250,000

Therefore, it is proposed that the City of Kitchener provide the Waterloo Catholic District School
Board with a payment of $28,000 to make up for the difference in land valuations, along with the
set conditions of grading and fill, to be covered by the project's capital account.
The City of Kitchener will also pay for the costs of preparation of the reference plan, conveyance
costs and the School Board legal fees, disbursements and GST, up to a maximum of $1,500.
COMMUNICATIONS:
The Council of the Whole, through report DTS-08-001, approved the construction of the
extensions of Hanson Avenue Lennox Lewis Way) and Block Line Road.
The extension of Hanson Avenue (Lennox Lewis Way) has been approved through the Ministry
of Environment's Class Environmental Assessment process, which included a series of public
contacts including letters, public meetings and newspaper advertisements.
The Waterloo Catholic District School Board has been involved and provided input throughout
this process.
Drewlo Holdings has also been advised through this process of the requirements related to the
need to gain access to their property for the purpose of executing an archeology study.
CONCLUSION:
In order for the required servicing to the new Twin Pad Arena to be completed in advance of the
arena's opening, as well as to increase accessibility to the area as recommended in the City of
Kitchener Twin Pad Arena Neighbourhood Connectivity Study, it is requested that the above
resolution be recommended for approval by Council to facilitate the completion of the
extensions of Hanson Avenue Lennox Lewis Way) and Block Line Road.
