EXECUTIVE SUMMARY:
The Planning Department has received an application for approval of a common element plan
of condominium comprised of a private driveway aisle with parking areas and a common
amenity area, as identified on the attached draft plan. Under a separate part lot control
application, Deerfield Homes Ltd. is proposing to create 82 freehold townhouse units (see
attached draft reference plan) on Tied Parcels of Land 1 through 4 shown on the draft plan and
tying each unit to the common element plan of condominium in accordance with the City's
Parcels of Tied Lands (POTL) Policy.
Council has delegated approval authority to the Manager of Development Planning for all
condominiums. However, recent changes made to Ontario Regulations (Ontario Regulation
544106) of the Planning Act now require a public meeting to be held for all common element
and vacant land plans of condominium to hold a public meeting.
RECOMMENDATION:
That the City of Kitchener, pursuant to Section 51 (31) of the Planning Act R.S.O. 1990,
Chapter P 13 as amended, and delegation by -law 2002 -64, grants draft approval to Plan of
Condominium Application 30CDM- 08205, in the City of Kitchener, for Deerfield Homes Ltd.,
subject to the following conditions:
1. That this approval applies to Draft Plan of Condominium 30CDM -08205
Deerfield Homes Ltd., prepared by GSP Group, dated April 1, 2008, which
shows a common element area comprised of parking, driveway aisles and
common amenity area.
2. That the final plan shall be prepared in general accordance with the above noted
plan, with a copy of the final plan being approved by the City's Manager of
Development Review.
3. That the Owner submit a draft Condominium Declaration, for approval by the
City's Manager of Development Review, containing the following provisions:
i) That private sidewalks, driveways and parking areas be maintained in a
snow free condition and void of any obstructions 12 months of the year.
ii) That the Owner agrees to maintain the subject lands in compliance with
the site plan approved by the City's Supervisor of Site Development, for
the life of the development on the subject lands.
iii) That common elements and units may be subject to easement
agreements with utility suppliers and the City of Kitchener for access
and /or maintenance purposes.
iv) That mail delivery will be from a Centralized Mail Box.
v) That a private contractor will pick up and dispose of all recyclables and
other waste materials from the subject lands.

vi) That the Owner implements the recommendations outlined in the
approved Salt Management Plan.
4. That the Owner covenant and agree in writing to the City's Manager of
Development Review to register a Condominium Declaration which shall include
the approved provisions as required in condition 3 hereof.
5. That the Owner make satisfactory arrangements with the City of Kitchener for
the payment of any outstanding Municipal Property Taxes, utility accounts
and/or local improvement charges.
6. The Owner shall make arrangements for the granting of any easements for
municipal services. The Owner agrees to comply with the following easement
procedure:
(a) to provide reference plan(s) showing the easements to HYDRO, and
telephone companies and the City, to the CITY'S Manager of Development
Review
(b) to ensure that there are no conflicts between the desired locations for
utility easements and those easement locations required by the CITY'S
Manager of Engineering Services for municipal services;
(c) to ensure that there are no conflicts between utility or municipal service
easement locations and any approved Tree Preservation /Enhancement Plan;
(d) if utility easement locations are proposed within lands to be conveyed to,
or presently owned by the CITY, the SUBDIVIDER shall obtain prior written
approval from the CITY'S Manager of Development Review and /or the CITY'S
Solicitor; and
(e) to provide to the CITY'S Manager of Development Review , a clearance
letter from each of HYDRO and telephone companies. Such letter shall state
that the respective utility company has received all required grants of easement,
or alternatively, no easements are required.
7. That the Owner confirm that sufficient wire -line
communication /telecommunication infrastructure is currently available within the
proposed development to provide communication /telecommunication service to
the proposed development to the satisfaction of Bell.
S. That the Owner make satisfactory arrangements with Canada Post for the
provision of mail delivery via a designated Centralized Mail Box including
providing a suitable centralized location on- -site, installing the concrete pad(s)
and advising prospective purchasers through purchase and sale agreements
that mail service is from a centralized facility.
9. That the Owner develop and maintain the site in compliance with the approved
site plan dated December 20, 2007.

10. That the Owner shall submit to the City of Kitchener a Letter(s) of Credit to cover
100 percent of the remaining cost of all outstanding and/or uncertified site
development works to the satisfaction of the City's Manager of Development
Review.
ii) The Letters) of Credit shall be kept in force until the completion and
certification of the required site development works in conformity with their
approved designs. If a Letter(s) of Credit is about to expire without renewal
thereof and the works have not been completed and certified in conformity with
the approved designs, the City may draw all of the funds so secured and hold
them as security to guarantee completion and /or certification, unless the City
Solicitor is provided with a renewal of the Letter(s) of Credit forthwith.
iii) In the event that the Owner fails to complete the required site development
works, to the satisfaction of the City's Manager of Development Review, then it
is agreed by the Owner that the City, its employees, agents or contractors may
enter on the lands and so complete and/or certify the required site development
works to the extent of the monies received under the Letter(s) of Credit. The
cost of completion of such works shall be deducted from the monies obtained
from the Letter(s) of Credit. In the event that there are required site
development works remaining to be completed, the City may by by -law exercise
its authority under Section 326 of the Municipal Act to have such works
completed and to recover the expense incurred in doing so in like manner as
municipal taxes.
iv) Other forms of performance security may be substituted for a Letters) of
Credit, at the request of the Owner, provided that approval is obtained from the
City Treasurer and City Solicitor.
11. That the project solicitors have provided their unqualified certification that the
proposed declaration for the proposed Common Elements Condominium has
been approved by the Registry Office and all signatures and certification
required to permit its registration have been included therein.
12. That the project surveyors have provided their unqualified certification that the
proposed description plans for the proposed Common Elements Condominium
have been approved by the Registry Office and all signatures and certifications
required to permit its registration have been included thereon, other than on the
behalf of the City of Kitchener.
13. That the City of Kitchener has been provided with the deposited reference plan
that will describe the proposed Parcels of Tied Land and that said reference plan
reflects the approved Site Plan and engineering drawings.
14. That a certificate has been received by the City of Kitchener from an Ontario
Land Surveyor confirming that all proposed foundation walls for the site have
been constructed and that the boundaries of the parts of the deposited reference
plan insofar as the same relate to dividing one proposed Parcel of Tied Land
from another within the confines of the building envelope lie on or within the
actual party wall foundation wall so as to ensure that no part of any proposed
Parcel of Tied Land lies beyond a party wall foundation wall, or the deposited

reference plan describing the Parcels of Tied lands must show the location of the
foundation walls to the satisfaction of the City of Kitchener.
15. That an irrevocable undertaking, irrevocably authorised by the proposed Declarant,
has been obtained from the proposed Declarant's solicitor and surveyor to
register the declaration and description plans for the proposed Plan of
Condominium forthwith upon:
i) the passage and registration of the Part -Lot Control Exemption By -law; and
ii} signing of the description plan approval or exemption box on the
description plans by the City of Kitchener; and, that the proposed Declarant
undertakes to the City of Kitchener that there shall be no conveyance of the
Parcels of Tied Land until such time as the Plan of Condominium description and
declaration have been registered on title. The City of Kitchener may withhold
registration of the Part Lot Control Exemption Bylaw pending the City of
Kitchener solicitor making escrow arrangements with the solicitor for the
proposed Declarant that are satisfactory to the City of Kitchener solicitor to
ensure the proposed declaration is registered immediately following the
registration of the Part Lot Control Exemption Bylaw.
16. That the Owner submits a Salt Management Plan to the satisfaction of the Region
of Waterloo.
17. That the Owner agrees to implement the recommendations outlined in the
approved Noise Study to the satisfaction of the Region of Waterloo in
consultation with the City of Kitchener.

3. That prior to the signing of the final plan by the Manager of Development Review, the
Manager shall be advised by Kitchener Wilmot Hydro that Condition 6 has been carried
out satisfactorily. The clearance letter should contain a brief statement as to how this
condition has been satisfied.

4. That prior to signing of the final plan by the Manager of Development Review, the
Manager shall be advised by Canada Post that Condition 8 has been carried out
satisfactorily. The clearance letter should contain a brief statement as to how this
condition has been satisfied.
5. That prior to the signing of the final plan, the Manager of Development Review shall be
advised by the Owner how Conditions 3 to 18 have been carried out satisfactorily. The
letter should contain a brief statement as to how these conditions have been satisfied
and any clearance letters, as required, shall be included.
NOTES:
1. The owner /developer is advised that the provisions of the Development Charge
By -laws of the City of Kitchener and the Regional Municipality of Waterloo will
apply to any future development on the site.
2. The condominium plan for Registration must be in conformity with Ontario
Regulation 43196 as amended, under the Registry Act.
3. Draft approval will be reviewed by the Manager of Development Review from
time to time to determine whether draft approval should be maintained.
4. It is the responsibility of the owner of this draft plan to advise the Regional
Municipality of Waterloo Department of Planning, Housing and Community
Services and the City of Kitchener Department of Development and Technical
Services of any changes in ownership, agent, address and phone number.
5. The owner /developer is advised that the Regional Municipality of Waterloo
has adopted By -law 96 -025, pursuant to Section 69 of the Planning Act,
R.S.O. 1990, c. P. 13, to prescribe a tariff of fees for application, recirculation,
draft approval, modification to draft approval and registration release of plans
of condominium.
6. This draft plan application was received on April 2, 2008 and shall be processed
and finally disposed of under the Planning Act, R.S.O. 1990, c. P.13, as of that
date.
7. To ensure that a Regional Release is issued by the Region's Commissioner
of Planning, Housing and Community Services to the City of Kitchener prior to
year end, it is the responsibility of the owner to ensure that all fees have been
paid, that all Regional conditions have been satisfied and the required
clearance letters, agreements, prints of plan to be registered, and any other
required information or approvals have been deposited with the Regional
Planner responsible for the file, no later than December 15th. Regional staff
can not ensure that a Regional Release would be issued prior to year end
where the owner has failed to submit the appropriate documentation by this
date.

8. When the survey has been completed and the final plan prepared to satisfy
the requirements of the Registry Act, they should be forwarded to the City of
Kitchener. If the plans comply with the terms of the approval, and we have
received assurance from the Regional Municipality of Waterloo and
applicable clearance agencies that the necessary arrangements have been
made, the Manager of Design and Development's signature will be endorsed
on the plan and it will be forwarded to the Registry Office for registration.

REPORT:
The subject lands are located at 7 Upper Mercer Street, legally described as Block 29,
Registered Plan of Subdivision 58M -392 encompassing an area of 2.48 hectares. The subject
lands are zoned Residential Six (R -6) and designated Low Rise Residential in the Official Plan.
Site Plan approval for an 82 unit townhouse development was granted (please refer to attached
site plan) in December 2007 and a Section 41 Development Agreement was entered into and
registered as instrument number WR354368.
The proposed plan of condominium identifies the roadway, parking and amenity area as
common elements. Tied Parcels of Land 1 to 4 will contain the townhouse units which will be
created through part lot control. Using the City's Parcels of Tied Land (POTLS) policy, Deerfield
Homes proposes to create 82 units which will then be tied to the common elements portion of
the plan.
FINANCIAL IMPLICATIONS:
None
COMMUNICATION:
A ency and Department Circulation
This plan was circulated to all required agencies and city departments on April 8, 2008. The
comments received have either been addressed or included as conditions of draft approval.
Neighbourhood Circulation
In accordance with Ontario Regulation 544106, a newspaper advertisement was published in the
Waterloo Region Record on May 23, 2008 advising the date of the public meeting to be held on
June 16, 2008.

CONCLUSION:
Authority to grant draft approval for plans of condominium has been delegated to the Manager
of Development Review by Council. However, recent changes to the Ontario Regulations
require a public meeting to be held for common elements and vacant land plans of
condominium. As such, this proposed common element plan of condominium is required to hold
a public meeting.
Staff therefore recommend that draft plan of condominium 30CDM- 08205, affecting 7 Upper
Mercer Street, legally described as Bloc 29, 58M -392 be approved subject to the conditions
noted in this report.

Hi Brian,
I can't send you full circulations comments as Bruce has not finalized his review of the
noise study. I can provide you with the following comments:
Water Resource Protection
Section 2.2 of the 2005 Provincial Policy Statement provides for the long -term
protection of groundwater supplies. The subject property is within a Sensitivity 2
Wellhead Protection Area as designated on Map 4 of the Regional Official Policies Plan
(ROPP) . Prior to final approval of the Plan of Condominium, the applicant must provide a
Salt Management Plan to identify winter maintenance procedures for the proposed Plan of
Condominium such as the quantity and type of snow /ice melting materials used, the
storage and handling of these materials, and the storage of snow cleared from the
parking areas. The completion of this management plan and implementation of the
same (by way of condominium declaration) can be made a condition of draft approval. By
copy of this letter, the applicant is requested to contact the undersigned for
additional information regarding this requirement.
In addition, any stormwater management plan and lot grading and drainage plan prepared
for the proposed Plan of Condominium should be developed with consideration given to
the loading of salt from de -icing operations to groundwater so as to ensure that
groundwater concentrations of sodium and chloride will remain within Reasonable Use
Guidelines established by the Ministry of the Environment.
Water Services (Engineering & Planning)
The subject property is to be serviced from Kitchener pressure zone 4. The HGL for
pressure zone 4 is 384.3 MASL any centreline road elevation below
327.9 m will require the services to be connected to individual Pressure Reducing Valves
(PRV) as specified in section B.2.4.7 of the Design Guidelines & Supplemental
Specification for Municipal Services (DGSSMS).
Existing contours for the subject site range from 315 m to 320 m.
As well, the Region advises the applicant that the Region of Waterloo is finalizing the
Tri -City Water Distribution Master Plan. One component of the master plan is to review
the existing pressure zone boundaries. As this application is located near the boundary
zone limits of the pressure zone some changes may or may not occur in the future.
Transportation Planning
Transportation Planning has received a noise report for the proposed development
but have not yet completed their review. However, the applicant should be advised that if
a noise wall is not required on Fairway Road, the owner /applicant will be required to
install a 1.82 metre high permanent, maintenance free chain link fence adjacent to
Fairway Road to the satisfaction of the Region of Waterloo.

Thank you for your letter of April 8, 2008 concerning the above application.
A detailed review of the Site Plan has been completed.
The following paragraph(s) are to be included as Conditions of Site Plan
Approval:
1. The Developer is hereby advised that prior to commencing any work within
the Plan, the Developer must confirm that sufficient wire -line
communication /telecommunication infrastructure is currently available
within the proposed development to provide communication /telecommunication
service to the proposed development. In the event that such infrastructure
is not available, the Developer is hereby advised that the Developer may
be required to pay for the connection to and /or extension of the existing
communication /telecommunication infrastructure. If the Developer elects
not to pay for such connection to and /or extension of the existing
communication /telecommunication infrastructure, the Developer shall be
required to demonstrate to the municipality that sufficient alternative
communication /telecommunication facilities are available within the
proposed development to enable, at a minimum, the effective delivery of
communication /telecommunication services for emergency management services
(i.e., 911 Emergency Services) .
The Owner shall agree in the Agreement, in words satisfactory to Bell
Canada, to grant to Bell Canada any easements that may be required for

telecommunication services. Easements may be required subject to final

This development will receive mail service to centralized mail facilities provided through our
Community Mailbox program.
I will specify the conditions which I request to be added for Canada Post Corporation's
purposes.
The owner shall complete to the satisfaction of the Director of Engineering of the City of
Kitchener and Canada Post:
a) include on all offers of purchase and sale, a statement that advises the
prospective purchaser
i) that the home/business mail delivery will be from a designated
Centralized Mail Box.
that the developers /owners be responsible for officially notifying the
purchasers of the exact Centralized Mail Box locations prior to the
closing of any home sales.
b) the owner further agrees to
i) work with Canada Post to determine and provide temporary suitable
Centralized Mail Box locations which may be utilized by Canada Post

until the curbs, boulevards and sidewalks are in place in the remainder
of the subdivision.
ii) install a concrete pad in accordance with the requirements of, and in
locations to be approved by, Canada Post to facilitate the placement of
Community Mail Boxes
iii) identify the pads above on the engineering servicing drawings. Said
pads are to be poured at the time of the sidewalk and/or curb
installation within each phase of the plan of subdivision.
iv) determine the location of all centralized mail receiving facilities in
co- operation with Canada Post and to indicate the 'location of the
centralized mail facilities on appropriate maps, information boards and
plans. Maps are also to be prominently displayed in the sales offices)
showing specific Centralized Mail Facility locations.
C) Canada Post's multi -unit policy, which requires that the owner /developer
provide the centralized mail facility at their own expense, will be in affect
for buildings and complexes with a common lobby, common indoor or
sheltered space.
Should the description of the project change, I would appreciate an update in order to assess
the impact of the change on mail service.

has the following comments,
This development currently lies Withln St. Daniel Catholic Elementary School's attendance
boundary. This area is currently undergoing an accommodation review and a decision will be made
in June regarding which school students in this area will attend in the future,
The Waterloo Catholic District School Board has a school site reserved on Pebblecreek Drive in
the adjacent development to the north. Students generated by this development will be within
walking distance of a new school if is built on this site. Therefore, staff is requesting sidewalks
sslong the frontage of both Upper Mercer Street and Woolner Drive connecting to the intersection
with Pebblecreek Drive and Fairway Road North.

Staff at the Grand River Conservation Authority have had an opportunity to review the above noted
application. We note that we have no objection to draft plan approval for the proposed condominium.
Although the property is regulated by the GRCA, a permit was previously issued for pre - grading on the
subject property and no further permits for development are required from the GRCA.
As a result we will not be providing any conditions for draft plan approval and we trust that the City of
Kitchener will ensure that stormwater management for the property is consistent with the stormwater
management plan approved for the subdivision.
