Daniel Kerr, Design & Construction Technologist Ward(s) Involved: Ward 2 Date of Report: May 29, 2008 Report No.: DTS 08-101 Subject: REQUEST FOR ADDITIONAL CONSULTING FEES STONEGATE WATERCOURSE RECONSTRUCTION RECO~~ENDATION: That the request for additional engineering fees of $ 46,913 (excluding G.S.T. submitted by McCormick Rankin Corporation relative for Design, Approval and Contract Administration for the Stonegate Watercourse Rehabilitation be approved. BACKGROUND: The Stonegate Watercourse includes the storm sewer outfall from Stonegate Drive and a natural gully system that flows between (and parallel to) Stonegate Drive and Highway 8, outleting to the Grand River. The storm sewer was originally constructed in the 1980s. Over a period of time the gully has deepened and eroded as a result of both natural causes and the additional runoff conveyed by the storm sewer outfall. By 2001 the erosion had become severe enough that the failed gully slopes were starting to encroach upon the residential properties that backed onto the watercourse. REPORT: In 2001, the City of Kitchener retained McCormick Rankin Corporation (MRC) to complete the Schedule B Class Environmental Assessment and preliminary design for the Stonegate Watercourse Erosion and Slope Stabilization project. The Environmental Study Report (ESR) for this project was completed in 2002. In 2005, the City retained MRC to complete the detailed design and Contract Administration (CA) services for this project. The total consulting fees for this project was $59,900, excluding applicable taxes, this includes the Design ($12,600), Contract Administration ($42,850), Post Construction services ($4,450) and a 5 percent contingency. The scope of work assumed that only minor refinement of the design presented in the ESR would be required. As well, the estimated Contract Administration fee was based on a preliminary estimated construction value of $285,000 and 25 Working Days for the contractor. During the design and construction stage there was need to increase the scope of work due to the following reasons: After discussions with various City Departments and the Public, it was requested that the consultant undertake the survey and stakeout to define grading limits of the watercourse, update the vegetation inventory, revised landscaping, submit and obtain approvals from MOE and GRCA, and additional meetings /liaison with different agencies and City staff. The proposed consultant fees for the above task were $15,773, excluding applicable taxes. The project was tendered and awarded in October, 2006 and the construction started in January 2007 to reduce erosion and achieve better slope stability. The total tender price was $428,911 with total of 52 working days. However, the consultant's contract administration fee estimate was $42,850 with a total of 25 working days. Therefore an additional 27 working days is required for the consultant to coincide with the contractor's proposal. Due to the above scope change, the consultant is requesting the City to increase fees for the detailed design in the amount of $15,773 and the contract administration fees in the amount of $31,140. The original purchase order was $59,900 excluding applicable taxes. Due to the scope changes there is a need to increase the purchase order from $59,000 to 106,813.00, excluding applicable taxes. Therefore, Staff recommend that MRC's purchase order be increased to complete this project. FINANCIAL IMPLICATIONS: The total additional funding of $46,913 excluding applicable taxes, is required to complete this project. The funding is available in the Stonegate Rehabilitation project, Index Code 855117. CONCLUSION: Due to the scope of change of this project, Staff recommends that MRC's request for additional fees be approved to complete this project. B.
