Subject: Land Exchange - 221 Paige Place
Part of Lot 33, Plan 58M-411, being Part 1 on Plan 58R-16240
in exchange for Part of Lot 112, GCT, being Part 3 of Plan
58 R-16240
RECOMMENDATION:
"That the lands known as Part of Lot 112, G.C.T. being Part 3 on Plan 58R-16240 be declared
surplus to the City's needs; and
That Council direct Legal Services and Facilities Management to initiate steps to exchange land
with JW's Project Management Inc., at no cost to the City of Kitchener; and,
That the Mayor and Clerk be authorized to execute a Land Exchange Agreement with JW's
Project Management Inc. wherein Part 3 on Plan 58R-16240 be conveyed to JW's Project
Management Inc in exchange for Part 1 on Plan 58R-16240, attached), satisfactory to the City
Solicitor; and further,
That the Mayor and Clerk be authorized to execute any further documentation necessary to
complete the land exchange transaction, satisfactory to the City Solicitor;"
EXECUTIVE SUMMARY:

REPORT:
The City was approached by the owner of 221 Paige Place to exchange a piece of land at the
front of the lot for an equal sized piece of land at the rear of the lot. The land that the City
owns abutting 221 Paige Place is designated as Parkland (P-3). The land being exchanged is

equal in size and allows for the lot at 221 Paige Place to be a rectangle sized lot rather than a
pie shape and allows for a more useful backyard. The owner has been made aware of the
possibility of a Zone Change for the land that is currently designated as Parkland and will be
dealing with the Planning Department directly on that issue if it is required.
FINANCIAL IMPLICATIONS:
The owner of 221 Paige Place will be responsible for all costs associated with the land
exchange, including the required Reference Plan, land valuations, and all conveyance costs.
There will be no cost to the City.
COMMUNICATIONS:
The Property Management Committee approved the possibility of a land exchange on June 9,
2008. The owner of 221 Paige Place is under a tight time-line as it is his intention to build a
house on the lot by November. The type of notice to be given to the public will be effected by
listing the matter on the Special Council agenda for August 11, 2008.
CONCLUSION:
Staff have agreed to the requested land exchange and it is recommended that the above
resolution be considered by Special Council on August 11, 2008 to facilitate the land exchange.
