MARY'S GENERAL HOSPITAL RECOMMENDATION: That Zone Chan a Application ZC081081PIKA for the purpose of extending Temporary Use g Provision #1 ~ for an additional three year period, on lands owned by St. Mary's General Hos ital to allow for offices ancillary to a hospital, on lands legally described as Registered p Plan 230 Part Lot 339, Registered Plan 699 Part Lot 1, municipally known as 9 Pleasant Ave, in the Cit of Kitchener be approved, in the form shown in the attached "Proposed By-law", Y dated Jul 7, X008, attached to DTS Report DTS-08-109 subject to the following condition: Y a. That the zoning by-law not receive three readings until the owners of both 9 Pleasant Avenue and 911 Queen's Boulevard, together, have provided the City of Kitchener with an Undertakin to provide parking as required by staff located at 9 Pleasant Avenue off-site g and off-street, to the satisfaction of the Director of Planning and the City Solicitor. BACKGROUND: The subject ro ert is owned by St. Mary's General Hospital and is located on the south side of the J p p Y intersection of Queens Boulevard and Pleasant Avenue. St. Mary's received approval in 2005 of a Tem ora Use provision to allow the existing house to be used for hospital offices, which were p ry dis laced as a result of hospital renovations. The Temporary Use provision expires November 28, p 2008 however the subject renovations and hospital improvements are not expected to be completed J b that time. Therefore, the owner is seeking an extension of Temporary Use Provision 11 T to allow Y their office to remain at 9 Pleasant Avenue for an additional three years. REPORT: Planning Comments: Planning staff feel that it is appropriate to extend Temporary Use Provision 11 T to allow St. Mary's General Hospital Foundation offices to continue to be located at 9 Pleasant Avenue, within the existing building only. A Temporary Use Provision can be renewed for a period not exceeding three years. Therefore, planning staff recommend that the Temporary Use Provision be renewed for three years from the date of the passing of the by-law. The lands are currently zoned Residential Five Zone (R-5) which permits a range of low-rise residential uses. Staff expect that upon expiry of the Temporary Use Provision, the property will revert to a permitted R-5 use. As discussed under the property owner comments below, parking for employees located at 9 Pleasant Avenue will continue to be located primarily off-site at the hospital's main parking lot. As part of the Temporary Use Provision, no on-site parking shall be required for the office use and no on-site parking shall be permitted beyond that which can be provided on the existing driveway. As a condition of the zone change, and prior to three readings of the by-law, staff recommend that the owners of both 9 Pleasant Avenue and 911 Queen's Boulevard, together, provide the City with an Undertaking to whereby they agree to provide parking, as required by staff located at 9 Pleasant Avenue off-site and off-street, to the satisfaction of the Director of Planning and the City Solicitor. Agency Comments: No objections received. Property Owner Comments: Staff received one written comment from a neighbouring property owner in response to the preliminary circulation. The property owner is concerned with vehicles parking in the driveway at 9 Pleasant Avenue. Planning staff understand that parking for staff located at 9 Pleasant Avenue is primarily located within the main hospital parking lot. However, staff feel that it is acceptable for vehicles to be parked on the existing driveway, provided they are not encroaching in the City's right-of-way. Staff feel that the impact of cars parked in this driveway for the office use is similar to the impact of cars parked for a single detached dwelling, As such, the Temporary Use provision is subject to no additional on-site parking being permitted, beyond the number of spaces that could be accommodated for a single detached dwelling. FINANCIAL IMPLICATIONS: No Capital expenditures required as part of the approvals or development of these lands. COMMUNICATIONS: Preliminary circulation of the Minor Zone Change was undertaken on June 3, 2008 to departments, agencies and all property owners within 120 metres of the site.
