PROPOSED ALTERATIONS: SIGNAGE AND PATIO
RECOMMENDATION:
That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application
HPA 2008-IV-018 be approved, to permit the installation of two projecting signs and the
construction of a patio at 70 King Street East, in accordance with the plans submitted with the
application, subject to the final building permit and sign permit drawings being reviewed and
heritage clearance issued by heritage planning staff prior to issuance of a building and sign
permit.

REPORT:
The subject property is located on the north side of King Street East and the west side of Frederick
Street in the City Commercial Core planning community, and is subject to designation under Part
IV of the Ontario Heritage Act.
The applicant's standard proposal for signage is an internally illuminated fascia sign. Heritage
Planning staff encouraged the applicant to consider the use of a Projecting Sign in order to
reduce the physical and visual impact of a fascia sign on the building elevations and heritage
attributes. In addition, the use of a Projecting Sign is consistent with the City's Downtown
Design Guidelines as they relate to signage in the City Centre District. Projecting Signs add to
the character of the downtown streetscape.
As a result of the discussions with Heritage Planning staff, the applicant proposes to install one
projecting sign on the Frederick Street elevation and one projecting sign on the King Street
elevation. The signs are proposed to be internally illuminated and will project 8.83 feet (2.69
metres) with an approximate total area of 32.5 square feet (3.02 square metres}. The signs are
constructed with a combination of materials including metal and plastic. The applicant requires a
variance through the Committee of Adjustment and Council from the City's Sign By-law to
address the type of lighting and the sign projection. The sign projection also requires the
applicant to enter into an Encroachment Agreement with the City.
The applicant is also proposing to construct a patio at the rear of the building along the
Frederick Street elevation. The patio will be constructed at grade with metal posts and tempered
glass. The rear of the patio that is located adjacent to Goodies Lane will feature a gas fireplace
wall with faux limestone tiles to match the existing building. The applicant requires approval
from the City's Site Plan Review Committee in order to construct the patio.
The design of the proposed signs and rear patio are consistent with what was illustrated on a
conceptual elevation plan for the adaptive re-use of the building, presented to Heritage
Kitchener and Council earlier in the year.
Depending on the approvals granted through the variance and site plan process, the proposal
may require further review and consideration by Heritage Kitchener.
City staff acknowledge the architectural importance of this building; however, staff are also
cognizant of the importance of adaptive re-use in assisting the long term conservation of
heritage buildings. Staff believe that the character of the building expressed through Solidity and
Motion of the limestone fagade and steel fins will be maintained and that the proposed
alterations are within an acceptable range.
In reviewing the merits of the application, City staff note the following:
The proposed projecting signs are encouraged in the City Centre District;
The proposed projecting signs will reduce the physical and visual impact to the building
din comparison to the standard fascia signs);
The proposed projecting signs will not detract from the character of the building;
The proposed patio is accessory to the building;
The proposed patio will integrate building materials that are similar to the building; and,
The proposed patio will not detract from the character of the building.

FINANCIAL IMPLICATIONS:
None.
CONCLUSION:
The proposed signage and patio will not detract from the heritage character of the existing
building. Accordingly, staff recommends approval of HPA 2008-IV-018.
