CITY OF KITCHENER
Heritage Kitchener met this date, chaired by Councillor M. Galloway, commencing at 4:00 p.m., with the
following members present: Ms. D. Kuehl and Messrs. F. Bishop, R. Dyck, Z Janecki, J. Kerr, E. Lucy, J.
Pavia and M. Stanz.
Others Present: Messers. T. Boutilier, L. Bensason and Ms. D. Gilchrist
1. 72 VICTORIA STREET SOUTH - DESIGNATION AND HERITAGE EASEMENT AGREEMENT
The Committee was in receipt of a Heritage Property Report prepared by Mr. L. Bensason for the
property municipally known as 72 Victoria Street South, outlining the properties historic and
architectural merits. In addition to the significant heritage features on the exterior of the building,
as outlined on page 3 of the report, Mr. Bensason requested that the following features be added:
the roof, roof line and foundation.
Mr. Bensason reviewed the Heritage significance of the property, the specific architectural features
worthy of designation, and recommended to the Committee that the property be designated
pursuant to Part IV of the Ontario Heritage Act. He also recommended that the City enter into a
Heritage Easement Agreement for this property so that it may be further protected.
Mr. Kevin Deforge, representing the property owner, was in attendance in support of both the
designation and Heritage Easement Agreement.
On motion by Mr. Z. Janecki -
it was resolved:
"That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be directed to
publish a Notice of Intention to designate the property municipally known as 72 Victoria
Street South (The Berlin Interior Hardwood Co.) as being of historic and architectural
significance, with the specific features of the designation being:
Exterior
The roof, roofline, foundation, all exterior elevations and additions including red and
yellow brick walls; brick pilasters that separate bays; brick corbelling at roofline;
concrete sills and lintels; brick voussoirs; window openings; main entrance portico
including doric columns, brick voussoirs, semi-elliptical opening and rounded concrete
steps; tie-rods and anchors; yellow brick chimney (single stack), and clean out for the
chimney.
Interior
All exposed heavy timber (post and beam) construction with 4-way steel post caps and
metal stirrups, timber capital and support members; all original hardwood and concrete
floors on all levels; all concrete and brick walls; all original wood ceilings; original
window on interior wall located at the ground floor loading entrance; original freight
elevator; column base with concrete casings in basement; original metal door and
hardware in basement leading to storage units; exposed cast iron sprinkler system;
interior foundation wall in basement; and further,
That the City enter into and the Mayor and Clerk be authorized to execute a heritage
easement agreement for the property municipally known as 72 Victoria Street South in
a form satisfactory to the City Solicitor."

2. 393 TILT DRIVE - DESIGNATION
The Committee was in receipt of a Heritage Property Report prepared by Mr. L. Bensason for
the property municipally known as 393 Tilt Drive, advising of this property's historic and
architectural merits.
Mr. Bensason reviewed the Heritage Property Report and requested that should the Committee
agree to recommend designation to Council, the single lane driveway not be included as part of
the specific features of the designation. Mr. Bensason advised that the City already has
entered into a Heritage Easement Agreement for this property. He also advised that the
property owners are supportive of the designation.
On motion by Mr. K. Kirby -
it was resolved:
"That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be directed to
publish a Notice of Intention to designate the property municipally known as 393 Tilt
Drive (Stauffer Log House) as being of historic and architectural significance, with the
specific features of the designation being:
All exterior elevations of the log house including the fieldstone foundation, square log
walls, chinking between logs, vertical boards at gable ends, window openings, windows
and sills, doors, front door entrance and opening, window and door wood trim, central
gothic dormer, roof and roofline, frieze, corbel capped end chimneys, and stone cellar
entrance with flat roof."
3. 787 & 811 MORRISON ROAD (FORMER SIMS ESTATE PROPERTY)
Mr. Bensason provided Committee members with copies of the report from the Architectural
Conservancy of Ontario (ACe) on the architectural and historic merits of 787 & 811 Morrison
Road, Kitchener, known as the Sims Estate. Committee members were also provided with
copies of a letter from Mr. Bensason to Mr. B. Hermsen, MHBC Planning Limited, dated
December 5, 2002, attached to which was the terms of reference for a Heritage Impact
Assessment for this property. Mr. Bensason advised that the City is requiring a Heritage
Impact Assessment be prepared for the proposed development on this site, and the Ace
report is the basis for the terms of reference. Mr. Bensason asked the Committee to review
the report and the terms of reference as they will be reviewing the Heritage Impact
Assessment once prepared.
4. DOORS OPEN WATERLOO REGION
The Committee was in receipt of a facsimile from Regional Councillor J. Halboom, dated
January 7, 2003, suggesting the Committee may wish to recommend the following properties
for Doors Open Waterloo Region; 38 Shirk Place, The Free Church in Bridgeport, Doon
Presbyterian Church and the ruins of the Doon Twine and Flax Mill. All properties meet the
Doors Open Waterloo Region criteria as being 150 years old. The Committee generally
agreed to recommend these properties to Doors Open Waterloo Region.
5. HERITAGE PERMIT APPLICATION 2003-V-01 - 2 HILDA PLACE
The Committee was in receipt of Heritage Permit Application 2003-V-01, for the property
municipally known as 2 Hilda Place, located in the Victoria Park Area Heritage Conservation
District. The application seeks permission to remove the existing rear addition, to construct a
rear deck, to alter the front porch, and to power wash the brick.
Mr. Bensason showed photographs of the subject property. Mr. M. Weir, agent for the
property owner, was in attendance to explain the application.
On motion by Mr. F. Bishop -
it was resolved:

5. HERITAGE PERMIT APPLICATION 2003-V-01 - 2 HILDA PLACE (CONT'D)
"That pursuant to Section 43 of the Ontario Heritage Act, Heritage Permit Application
2003-V-01 be approved to alter the designated property municipally known as 2 Hilda
Place, located in the Victoria Park Area Heritage Conservation District, by removing the
rear addition and replacing it with a deck, altering the front porch, and power washing
the brick, as outlined in the application."

HERITAGE PERMIT APPLICATIONS 2003-V-02 & 2003-V-03 - LOTS 1 & 2, REGISTERED
PLAN 58M-230, OREGON COURT
The Committee was in receipt of Heritage Permit Applications 2003V-02 & 2003-V-03
requesting permission to construct two single family dwellings with attached garages, one on
each of Lots 1 & 2, Registered Plan 58M-230, Oregon Court, as shown in the drawings
attached to the applications.
The Committee was also provided with copies of a written submission from Mr. R. Halboom,
dated January 7, 2003, outlining his objections to the Committee's consideration of these
applications.
Mr. Bensason displayed photographs of the subject properties, showing the lots from various
angles and showing the abutting properties.
Mr. J. Kuiken, Charleston Homes, was in attendance to explain the application and displayed
samples of the building fabric and colours for each house.
When questioned by Mr. E. Lucy concerning the heights of the proposed houses in relation to
those existing on Doon Village Road, Mr. Kuiken advised that the height would be roughly the
same as those on surrounding properties. Mr. Lucy noted that these are large lots that do not
have much depth, and he is concerned that the proposed 2-two and a half storey homes will
overshadow the existing 1¼-2 storey homes on Doon Village Road.
With respect to the siting options proposed by the owner for Lot 2, as shown on the plans
attached to the alteration application, the Committee generally agreed that either of the two
options would be acceptable.
On motion by Mr. Z. Janeki -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, Heritage Permit Application
2003-V-02 be approved to permit construction of a new single family dwelling and garage
on Lot 1, Registered Plan 58M-230, Oregon Court, located in the Upper Doon Heritage
Conservation District, as shown on the plans submitted with the application, using the
following building materials and colours:
· Brick - Canada Brick'San Antonio'
· Stone - Arriscraft Stone Citadel 'French Country Blend'
· Soffits, Fascia, Windows - Sandalwood
· Shingles - CSR Quantum Driftwood 25 year shingles
· Stucco - STO Oatmeal 2095."

Conservation District, as shown on the plans submitted with the application, using the

· Stone - Arriscraft Stone Citadel 'French Country Blend'
· Soffits, Fascia, Windows - Sandlewood
· Shingles - CSR Quantum Driftwood 25 year shingles

That the siting of the building on the lot, in either 'Option A' or 'Option B' as shown on the
submitted plans, be at the discretion of the owner."

PROPOSED AMENDMENT TO MUNICIPAL PLAN TO IMPLEMENT THE BROWNFIELDS
STATUTE LAW AMENDMENT ACT (2201)
Mr. T. Boutilier was in attendance to provide Committee members with an explanation of a
proposed amendment to the portion of the City of Kitchener Municipal Plan dealing with
Community Improvement Areas, as a result of the Brownfields Statute Law Amendment Act
(200'1). Committee members were in receipt of this proposed amendment as attached to their
agenda.
Mr. Boutilier explained the term "Brownfields" as being environmental contaminated sites,
noting that because of Kitchener's industrial heritage, there is land within the heart of the City
that is contaminated. Under the current situation it is difficult to get investors to purchase and
remediate these sites. Additional tools and financing is required in order to have these
properties put back into productive use.
With the passing of enabling legislation, it is now possible to amend the Municipal Plan to
expand the Community Improvement Areas to cover the whole of the City, following which
financial incentives can be developed.
Mr. Boutilier then advised that the proposed Municipal Plan Amendment relates to certain
heritage properties, as there are some heritage properties that are also Brownfields, and
these properties will become eligible for the proposed financial incentives.
