RECOMMENDATION
That Expression of Interest E05-033, Legal Services -Environmental Law, be awarded to the
following Legal Firms, and that the firms be registered for appointments as required: Birchall
Northey, Toronto; Cassels Brock & Blackwell LLP, Toronto; Davis & Company LLP, Toronto;
Dianne Saxe Professional Corporation, Toronto; Hodgson Post LLP, Hamilton; Joseph F.
Castrilli, Toronto; and Willms & Shier Environmental Lawyers LLP, Toronto.
REPORT
In accordance with Chapter 170 of the Municipal Code pertaining to the Selection of
Professional Services/Consultants, a Consultant's Review Committee was established consisting
of L. MacDonald, Director of Legal Services, F. McCrea, Assistant City Solicitor, J. Sheryer,
Assistant City Solicitor, and L. Gordon, Director of Purchasing.
Expressions of interest were advertised on the City of Kitchener Home Page and in the Ontario
Reports. By the closing date of Monday June 6th, 2005, twenty-eight (28) responses had been
received. The Review Committee met on Tuesday November 8th, 2005 to review the
submissions.
The Review Committee met on Monday December 5th to review ratings and make final
selections.

From time to time the City needs the assistance of outside counsel with expertise in
environmental law. In an effort to eliminate delays in securing the most appropriate legal
counsel when the need arises, Legal Services issued an Expression of Interest for the purposes of
creating a registry of pre-approved legal counsel with environmental law expertise which the
City can draw upon, on a case by case basis, should it be required.
The inclusion of a law firm or lawyer on the City's registry does not guarantee that the law firm
or lawyer will actually be retained by the City during the existence of the registry. Each retainer
will be non-exclusive. Which law firm or lawyer is retained for any particular matter is in the
discretion of the City. The City may award all or part of its available legal work to one or more
lawyer or law firm based upon specific expertise or other considerations as they relate to the
facts of the situation requiring such advice. The City does not represent that the Expression of
Interest E05-033 will necessarily result in the retention by the City of any lawyer or law firm.
Nor is there any guarantee of value or volume of work.
FINANCIAL IMPLICATIONS
There are no financial implications unless specific projects are directed by Council.
