Subject: REQUEST FOR EXEMPTION FROM CHAPTER 745 (GUNS)
— FLAG RAIDERS PAINTBALL — 425 BINGEMANS CENTRE
DRIVE
RECOMMENDATION:
That Flag Raiders Paintball, 425 Bingemans Centre Drive be granted an exemption from
Chapter 745 (Guns) to permit paint ball guns and soft air guns to be discharged at their
business location.
BACKGROUND:
On May 20, 2008 City Council passed Chapter 745 with respect to Guns in the City of
Kitchener. The by-law does not permit the discharge of any guns within the City, except for the
uses described in Sections 745.2.4 to 745.2.12. Paintball operators are not one of the
exceptions in the by-law. It does, however, provide for the opportunity for a person to make
application to Council for an exemption to the by-law by providing certain information to the
Manager of Licensing, including:
• The nature of the proposed exemption
• A police clearance letter for the person seeking the exemption
• The location of the premises to be used and
• The measures to be taken to prevent accidents or damage to persons or property

The Manager of Licensing has received an Application for Gun Exemption from Flag Raiders
Paintball, 425 Bingemans Centre Drive requesting that they be granted an exemption from
Chapter 745 (Guns)of the City of Kitchener Municipal Code to permit them to discharge paintball
guns at their location at 425 Bingemans Centre Drive. They have provided the Manager with all
the relevant information with respect to the requirements of the by-law and everything is in
order.
A Police Clearance Letter has been provided by the applicant and the Chief of Police was
contacted and expressed no concerns with this operation. The applicant also provided
evidence that they have extensive safety precautions in place and all staff have had extensive
training in order to ensure the safety and well being of all participants.
