Gosse, Director of Legislated Services/City Clerk Prepared By: Patricia Harris, Manager of Licensing Ward(s) Involved: *. =_0 11nieport: November 7, 2001 Report No.: CRPS-08-182 Subject: REQUEST TO AMEND CHAPTER 533 OF THE MUNICIPAL CODE (MASTER DRAIN LAYER) That staff prepare a by-law to amend Chapter 533 of the Municipal Code (Master Drain Layer) to amend the definition for "Master Drain Layer" and add a definition for "drain laying work". BACKGROUND: The City of Kitchener has licensed Drain Layers since 1973. A Master drain layer is currently defined in Section 533.1.2 as 66a person who is skilled in the planning, superintending and laying of drains on private property between the property line, or in the case of a water main, between the property line or shut off box and a point not more than 0.609 metres (2 feet) inside the outside wall of a building. A Master Drain Layer shall have a regular place of business in Ontario and a Master Drain Layer shall lay drains and/or supervise drain layers who lay drains." �014 On October 26, 2005, the Ontario Labour Relations Board ruled that the work of laying metallic or non-metallic pipe into trenches to form sanitary or storm sewers, drain or water mains did not need to be completed by a qualified plumber. Prior to this ruling, drain layers were only permitted to lay drains outside buildings. A Certified Plumber completed any drainage inside a building. On June 18, 2008, the City Clerk received correspondence from Robert A. Celsi, Executive Director of the Ontario Concrete and Drain Contractors Association requesting that the City amend Chapter 533 (Master Drain Layer) to reflect the ruling of the Ontario Labour Relations Board. After discussion with staff the definition for "Master Drain Layer" has been amended to permit a master drain layer to lay drains both inside and outside buildings. This amendment will satisfy the decision of the Ontario Labour Relations Board. In order to clarify the type of work that a drain layer may perform a definition for "drain laying work" has been added to Chapter 533. FINANCIAL IMPLICATIONS: None COMMUNCIATIONS: A copy of the draft amending by-law was forwarded to the Ontario Concrete and Drain Contractors Association requesting their comments or concerns.
