Subject: SANDROCK GREENWAY -NOISE EXEMPTION
RECOMMENDATION:
That the City of Kitchener and its contractor(s~ be exempt from the provisions of Chapter
450 Noise of the City of Kitchener Municipal Code Article 6 Construction Work during the
reconstruction of the Sandrock Greenway Sanitary Trunk Sewer Replacement -Phase 1
in the City of Kitchener. The request for the noise by-law exemption is only between the
hours of 7:00 p.m. to 7:00 a.m. for the period from November 7, 2008 to January 31, 2009.
BACKGROUND:
In order to address, relieve and control basement flooding in the area, the Sandrock Greenway
Sanitary Trunk Sewer Replacement Contract T08-066 project has been initiated and some
nighttime work must take place in order to complete the project in the time allotment. This
exemption is requested in orderto complete the work as required. This entire project is
proposed to take place from October 6, 2008 to approximately September 30, 2009.
SCOPE OF WORK:
The work involves the replacement of the Sanitary Trunk Sewer on the Sandrock Greenway
from Highland Road to the Hydro Corridor boundary near Royal Orchard Drive crossing several
intersections along the way. There will be significant capacity improvements with this project
which include:
Upgrade to the existing sanitary sewer and maintenance holes.
Replace existing sanitary sewer in selected areas.
Minimum water main replacements.
TYPE OF NOISE:
In order to complete the work along the Sandrock Greenway, a by-pass pump is required to be
operated. This pump must run 24 hours a day 7 days a week at times to by-pass sewage while
the new pipes are installed in the same location as the existing pipes. Crews will attempt to
minimize their nighttime noise.
DURATION:
These by-pass pumps may be utilized for the entire length of the project, from November 7,
2008 to December 19, 2008 and then again from January 5 to January 31, 2009.
TYPE OF NOISE:
Noise protocol will be followed, which covers administrative measures such as scheduling of
noisy activities at times of least impact, understanding that these pumps may be used only
during necessary times for by-pass pumping purposes. The operational noise generated by the
pumps is in the range of 68 dBa, and are listed by the supplier as `Sound Attenuated Sewage
Bypass Pumps" or "silenced pumps". As quoting one supplier, they indicate: "In today's
environment it is not only important to get the pumping accomplished, it is important to do this
without disturbing the neighborhood. These pumps offer this combination of performance and
quiet operation." The hours are unpredictable but may be in operation 24 hours a day, 7 days a
week during the dates listed above.
In order to allow the Contractor to complete their work and allow extended hours for the
necessary pumps to operate, we recommend that this request for a noise by-law exemption be
granted.
FINANCIAL IMPLICATIONS:
None.
COMMUNICATIONS:
The City of Kitchener and its contractor will communicate the expectation of extended working
hours to area residents and have been actively advising of any changes as they develop.
CONCLUSION:
In order to allow the contractor to safely complete their work and allow extended hours of work
to take place for this project, thereby minimizing sewage problems during the construction, we
recommend that this request for a noise by-law exemption be granted.
