That Zone Change Application ZC081161SIKA for the purpose of changing the zoning from Residential Five (R-5) to Residential Six (R-6) with Special Regulation Provision 483R on lands legally described as, Part of Lot 438 Grange's Survey, Plan 316, municipally known as 80 Shanley Street in the City of Kitchener be approved in the form shown in the attached "Proposed By-law" dated October 1, 2008 attached to DTS Report DTS 08-163. 1 EXECUTIVE SUMMARY: A zone change application was received for an existing five-plex located at 80 Shanley Street. The applicant would like to legalize the existing five-plex by changing the zoning to Residential Six Zone (R-6) with Special Regulation Provision 483R. The Special Regulation will limit multiple dwellings to the existing building, limit the number of permitted units to five, permit a lot width of 13.3 metres, a side yard setback of 1.35 metres and a maximum Floor Space Ratio of 0.75. BACKGROUND: The subject property is located on the north side of Shanley Street between Moore Avenue and Dekay Street, and is currently zoned Residential Five Zone (R-5} which permits multiples with a maximum of three units. The building was originally constructed as a four-plex in 1962 and the fifth unit was added in approximately 1988. There is no history of complaints about this property. The subject property is in the area included in the recent Triplex Study. This study was completed to determine whether triplexes should remain a permitted use in R-5 zones. Planning staff concluded that triplexes should remain a permitted use in the R-5 zone subject to certain requirements including a minimum of 1 parking space per unit and a minimum of 20% of the lot area being landscaped. Council approved the recommendations of the Triplex Study and also directed that properties in the Mount Hope-Huron Park and K-W Hospital Planning Communities that do not meet either the minimum lot width or minimum lot area of the R-5 zone, be downzoned to prohibit the creation of new triplexes. REPORT: 1. Planning Comments The surrounding neighbourhood consists predominantly of single detached dwellings, duplexes, and multiple unit dwellings with R-5 zoning, with the exception of a church and school, located to the west of the subject property, both zoned Neighbourhood Institutional Zone (I-1 }. The City's Official Plan designation is Low Rise Residential which supports low rise multiple unit dwellings and is intended to accommodate and encourage a full range and mixture of housing types. The Official Plan recognizes that the creation of additional housing in existing developed areas, through conversion, infill and redevelopment, is an appropriate response to changing housing needs and that it is a way of making better use of existing infrastructure. Staff are of the opinion that the proposal to legalize the existing five-plex is in keeping with the Official Plan policies. Furthermore, the Regional Official Plan, Places to Grow Act, and Provincial Policy Statement also support intensifying already built-up areas, and encourage infill development where appropriate. Staff are of the opinion that the proposed zone change is consistent with Regional and Provincial policies. In terms of the City's Zoning By-law, the existing R-5 zone permits: coach house dwelling units, duplex dwellings, home businesses, lodging houses, triplexes, private home day cares, residential care facilities, semi-detached dwellings, and single detached dwellings. The proposed new Special Use Provision 1290 prohibits the development of new triplexes on the subject property because the lot does not meet the minimum lot width requirement. If the subject building were an existing triplex it would be considered legal non-conforming. As previously discussed, the building was originally constructed in 1962 as a four-plex, which was permitted at the time. The fifth unit was added in the basement of the building in about 1988. The owner has requested that the zoning on the property be changed to Residential Six 2 Zone to legalize the existing five-plex. The requested R-6 zoning permits all of the uses in the R-5 zone, as well as street townhouses and multiple dwellings with more than three units. Because the fifth unit was added without permission or building permits, Planning requested that Fire complete an inspection of the building. Staff are in receipt of a letter from the Fire Department dated September 29, 2008 stating that the building is in compliance with the Ontario Fire Code (letter and inspection certificate are attached in Appendix `C'). Therefore, staff are satisfied that the subject building is safe for tenants. Staff are of the opinion that the existing five-plex should be legalized for the following reasons: • The building was constructed legally in 1962, and no exterior additions have been made. • The fifth unit has been in existence for about 20 years with no history of complaints from neighbours ortenants • Fire staff have confirmed that the building as a multiple meets the requirements of the Ontario Fire Code. • Sufficient parking is provided for tenants. A minimum of five parking spaces are required. Seven parking spaces are provided -two within a garage and five in the rear yard. Staff propose that a Special Regulation Provide 483R be added to the property. The purpose of the regulation is to permit a lot width of 13.3 metres rather than 15 metres, a minimum side yard setback 1.35 metres rather than 2.5 metres, and a maximum Floor Space Ratio ~FSR) of 0.75 rather than 0.60. Each of the deficiencies is a result of the building having been built in 1962 under different regulations. The deficiencies cannot be considered legal non-conforming because the five-plex use is not legal. With respect to the FSR the Official Plan allows for additional floor space to be permitted above 0.60 only "to the extent of the development previously approved". Therefore, as the subject property has had no history of alterations that affect the floor space, an increase in maximum floor space ratio should be allowed due to the fact that it retains the original floor space that was approved when the building permit was approved. Overall, staff feel that all the proposed exceptions contained in the Special Regulation are acceptable, for the existing building only, because they legalize the structure as originally approved, and there will be no change to the streetscape or character of the neighbourhood. Furthermore, staff understand that there is some level of concern from the neighbourhood that permitting the zone change may result in a change to the built form of the community and its character. As such, Special Regulation Provision 483R also restricts any multiple dwelling use to the existing building, and to a maximum of five units. This means that if the property were to be redeveloped, it could not contain a multiple, including a triplex, without a further zone change. Staff feel that this regulation will reasonably allow the existing use but also maintains the spirit of the proposed prohibition of triplexes on the site. 2. Property Owner Comments A circulation period was provided to allow for property owners to comment on the application. A total of seven comments were received -four in support of the application, and three in opposition. Of those in support, one property owner specifically commented that the property has always been well maintained and quiet. Two of the property owners in objection to the proposal did not give specific reasons. The third felt that that the neighbourhood should be kept as it is, concerned that others may follow the example eventually changing the neighbourhood's overall character. Staff comment that there are no changes proposed to the building as a result of the proposed zone change. The purpose of the change along with the special regulation will 3 only legalize a multiple in the existing building, to a maximum of five units. The owners could not replace the existing building with another type of multiple dwelling, and cannot expand the existing building, as the maximum Floor Space is limited to 0.75 which is what is currently on the property. 3. DepartmentlAgency Comments The application was circulated to all applicable agencies and internal departments, and no objections vuere received. Transportation Planning has noted that adequate parking is required to accommodate the use. Planning staff Hate that five parking spaces are required far the site, and that seven spaces have been established in the rear yard. FINANCIAL IMPLICATIONS; No Capital expenditures required as part of the approvals or development o these lands. CoMI~IUNICATIQNS: Preliminary circulation of the zone change application was undertaken on August 5, 200$ to applicable internal departments, agencies, and property owners within ~ 20m of the subject property. The comments are discussed in the report above and are attached as Appendices C and D. coNCLUSION: In summary, the Department of Development and Technical Services recommends that Zone Change Application ZC081 61S1KA for the purpose of changing the zoning from Residential Five Zone ~R-5~ to Residential Six Zone ~R-6~ with Special Regulation Provision 4838 be approved in the form shown on the attached by-law.
