The Committee was advised that the applicant requests permission to construct a new retail store
with a rear yard of 1.5 m (4.92 ft.) rather than the required 7.5 m (24.6 ft.), a southerly side yard of
1.5 m (4.92 ft.) rather than the required 7.5 m (24.6 ft.), and permission to locate parking within 0.9
m (2.95 ft.) of the lot line abutting Highway 8 rather than the required 3 m (9.84 ft.).
The Committee considered the request of Planning Division staff to defer consideration of this
application until the applicant has submitted, and staff have reviewed, a site plan application for this
proposed development.
Mr. B. Sloan advised that since the Planning Division comments were written, the applicant has
submitted an application for site plan approval. Staff believe that the site plan application can be
reviewed, and new comments on the Minor Variance application prepared, in time for the
Committee of Adjustment meeting of February 11, 2003. He requested that the application be
deferred until February 11, 2003, and advised that the applicant is in agreement with this request.

The Committee was advised that the applicant requests permission to erect a canopy over the
front entrance with a setback from Gaukle Street of 0.765 m (2.5 ft.) rather than the required 3 m
(9.84 ft.).

When questioned by the Committee as to whether the dimensions on the site plan are accurate,
Mr. Reichard advised the measurements included in the site plan are taken from a survey of the
property, and the canopy will be located entirely within the applicant's property.

APPROVED, subject to the following condition:

It is the opinion of this Committee that:
1. The variance requested in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
The general intent and purpose of the City of Kitchener Zoning By-law and Municipal Plan is
being maintained on the subject property.

Mr. S. Head advised that similar applications were approved in 1997, but the lots were not severed
prior to the 1997 Consent approvals lapsing. With respect to the Planning Division's comments
that the Applications for Minor Variance which were approved in 1997 are still valid, Mr. Head
withdrew the current Applications for Minor Variance.
With respect to the 2 conditions requested by the City to the approval of Submission No.'s B 2003-
003 to B 2003-005, Mr. Head advised that it was his understanding that the 5% cash constribution
in lieu of parkland dedication had been paid in 1997. He requested the words "if required" be
added to that condition, which was generally agreed to by the Committee.

That the application of Habitat For Humanity Waterloo Region Inc. requesting permission to convey
and mortgage a parcel of land having a width on Grulke Street of 13.33 m (43.73 ft.), a depth of
approximately 29.7 m (97.44 ft.) and a lot area of 295 m2 (3,175.45 sq. ft.) on Part of Lot 38,
Registered Plan 775, being Part 2, Reference Plan 58R-10961, 238 Grulke Street, Kitchener,
Ontario, BE GRANTED, subject to the following conditions:
That the owner shall pay to the City of Kitchener a cash-in-lieu of parkland dedication equal to
5% of the value of the land to be severed, if required.
That the owner shall make satisfactory arrangements with the City of Kitchener for the
payment of any outstanding municipal property taxes and local improvements charges.
It is the opinion of this Committee that:
A plan of subdivision is not necessary for the proper and orderly development of the
municipality.
The requirements of the Zoning By-law are being maintained on the severed lands and the
retained lands.
The use of the land in the application conforms to the City of Kitchener Municipal Plan and
the Regional Official Policies Plan.
Pursuant to Subsection 41 of Section 53 of the Planning Act, the applicant shall fulfil the above-
noted conditions within one year of the date of giving notice of this decision.
Pursuant to Subsection 43 of Section 53 of the Planning Act, the decision of this Committee shall
lapse two years from the date of approval, being January 14, 2005. Carried

payment of any outstanding municipal property taxes and local improvements charges.
