ENCROACHMENT AGREEMENT REQUEST - EXISTING
HOUSE OVER STORM SEWER AND SANITARY SEWER
EASEMENT AT 46 STOKE CRT.
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement,
satisfactory to the City Solicitor, with the property owner(s) and any mortgagee(s) of the
property municipally known as 46 Stoke Crt. (PIN 22453-0136 L T) and subject to an
easement registered as Instrument Number 672735, to legalize the existing
encroachment of the front left corner of the house which extends approximately 3', more
or less, onto the easement."
REPORT:
It has come to the attention of the solicitor acting on the purchase of the subject property that
the front left corner of the existing house, which was built in 1983, has been constructed
approximately 3' onto an easement. The easement, registered as Instrument Number 672735,
is a City sanitary sewer and storm sewer easement. A property survey is attached which
illustrates the location of the house encroachment over the easement.
Engineering Services has no objection to the house encroaching on the easement. They have
noted that the house is located approximately 20' away from the 24" diameter sanitary sewer
and the sewer is located 14' below ground.
CONCLUSION:
The appropriate staff has reviewed this request and has no concerns with the location of the
existing house encroachment.
