Development Techn~ca~ Services Report To: Development and Technical Services Committee Date of Meeting: May 12, 2008 Submitted By: Jeff Willmer, Director of Planning (519-741-2325) Prepared By: Juliane von Westerholt, Senior Planner (519-741-2776) Ward(s) Involved: South -Councillor Kelly Galloway Date of Report: May 5, 2007 Report No.: DTS-08-071 Addendum to Report to DTS-08-013 Subject: Southwest Kitchener Subdivisions Tru-Villa Incorporated-2040769 Ontario Limited (Mattamy Homes); Karen and Gordon Doehn Northwest Corner of Fischer-Hallman Road and Huron Road RECOMMENDATION: That Report DTS-08-071 be received for information purposes, regarding the circulation of plans of subdivision and rezoning applications for Tru-Villa Incorporated-2040769 Ontario Limited (Mattamy Homes); Karen and Gordon Doehn at the northwest Corner of Fischer-Hallman Road and Huron Road. REPORT: The subject properties are located on the west side of Fischer-Hallman Road, north of Huron Road and east of Amand Drive and are highlighted on the map above. The applicants, Gordon and Karen Doehn and Tru-Villa Incorporated (2040769 Ontario Limited) also known as Mattamy Homes, are proposing 2 plans of subdivision for the subject lands and are also proposing the rezoning of the subject lands from the current Agricultural zone to a variety of residential zones, and some commercial zones for neighbourhood commercial type of uses typically found in complete communities. The applications were received on October 1St, 2007 and were complete applications as per the Planning Act. The applications were not circulated at the time as the Alder Upper-Strasburg Sub-watershed Study had not yet been completed and the City of Kitchener's Growth Management Strategy had also not been completed. On March 3rd, 2008, a report was submitted to DTS to obtain some direction concerning the circulation of applications, on the west side of Kitchener, which are currently outside of the designated urban area for the city and are still awaiting Official Plan Amendments to bring these lands into the same. The West Side Lands report was deferred pending the adoption of the Alder Upper-Strasburg Sub-watershed Study report, which had also been deferred at the March 3rd, 2008 meeting. Since the March 3rd meeting it has been brought to Staff's attention that a commitment was made by Senior Staff at an earlier Development and Technical Services Committee Meeting held on March 5t", 2007 to process and circulate any complete applications that were received in 2007, including applications for lands within the West Side Area. These comments were made prior to the finalization of the Terms of Reference for the City's Growth Management Strategy. In recognition of this prior commitment, Staff will be circulating the applications made by Mattamy Homes. In addition, the Municipal Plan Amendment for the subject lands submitted in 2005 will also be re-circulated to obtain current comments on the application, as comments received to date suggested the application was premature pending the completion of the Alder Upper-Strasburg Sub-watershed Study. As the sub-watershed study is complete and is intended for adoption by Council, it was determined by staff that a re-circulation at this time would be appropriate.
