RECOMMENDATION:
That Part Lot 12, easley's Broken Front Concession designated as Parts 6, 7 and 8 on reference
Plan 58R-13892, in the City of Kitchener (shown as Parcel A on the attached Schedule "A "} be
declared surplus to the City's needs and}
That Part of Block 11, Registered Plan -279, designated as Parts 1 and 2 on undepesited
reference plan prepared by Guenther Rueb Surveying Limited - their file number B -2193, in fhe

City of Kitchener (shown as Parcels B and E on the attached schedule "A"), be declared surplus to
the-City's needs and,
That Block 21, Registered Plan M -326, designated as Parts 1, 2. and 3 -on undepesit d reference
plan prepared by Guenther I u b Surveying Limited - their file number -2192, in the City of
Kitchener (shown as Parcel G on the attached schedule "A "), be declared surplus to the City's
needs and further,
That Part of Let 11, Bearsle is Broken Front Concession designated as Part 2 on Reference Plan
5i -1 0533, in the City of Kithener (shown as Parcel C on the attached schedule "A ", be
declared surplus to the City's needs.

REPORT:
On September 1 , 2007 Council authorized a land exchange with ,NHS Properties Inc. which
involves the conveyance to JHS Properties Inc. f those lands identified . s Parcels A, B, E and G
on the attached Schedule "A" in exchange for the lands identified as Parcels D and C. Parcel C is
currently owned by the Grand River Conservation Authority.
Council has further arutheried a land exchange with the Grand Fiver Conservation Authority to
acqui ' re the land identified as Panel C on the attached Schedule "A" in exchange for the lands identified as Parcel A and a cash payment of $250,000.00. Parcel A will then subsequently be
conveyed to JHS Properties Inc. and the City will retain ownership of Parcel D for the purpose of
maintaining the shoerg Barn, a heritage structure, on the Pioneer Tower Fridge.
To facilitate the closing of the above transactions on December 1 g, 2008, Parcels A, 131 E, G and- C
must be designated as surplus to the City's needs.
FINANCIAL IMPLICATIONS: .
ILIA — Council has previously authorized the exchange of lands with JHS Properties Inc. and the
Grand River Conservation Authority.
COMMUNICATIONS:
A copy of this Report has been provided to Jeff 11 illrn r, the Grand River. Conservation Authority
and JHS Properties inc.
It is requested that the above resolution be -approved by Council to facilitate the completion of the
transactions.
