Subject: REPEAL AND REPLACE CHAPTER 554 OFTHE
MUNICIPAL CODE LOTTERIES}
RECOMMENDATION:
That Chapter 554 (Lotteries) of the Municipal Code be repealed and replaced based on the
proposed by-law attached to Corporate Services Department Report CRPS-09-002.
BACKGROUND:
In August 1987, Council passed By-law 87-180 which is currently Chapter 554 (Lotteries) of the
Municipal Code. It was last amended in September of 2000. This by-law appoints the Lottery
Licensing Officer for the City and regulates how lottery licenses are issued. It also sets the
licensing fees that the City will charge within the parameters of the Guidelines as set by the
Alcohol and Gaming Commission of Ontario. There have been several changes made to the
Provincial Lottery Regulations in recent years which require that this by-law be updated.
REPORT:
The following changes have been made to Chapter 554.
The Manager of Licensing has been appointed Lottery Licensing Officer instead of the
City Clerk. This change has been made because the Manager of Licensing is required
to deal with all aspects of Lottery Licensing within the City including collection of fees,
issuance of licences and enforcement and is also the liaison with the officials at the
Alcohol and Gaming Commission.
A Police Clearance Letter from the Waterloo Regional Police will no longer be required
for first time Lottery organizations. Staff determined that requesting this letter would
serve no purpose unless all members of an organization were required to obtain this
letter. This would be onerous and expensive for the organization.
The Alcohol and Gaming Commission provide Guidelines to municipalities regarding the
amount of licence fees that can be charged by a municipality. Currently, the City
charges the maximum licence fee for bazaar, raffle and break open ticket lotteries and
Council has set a fee of $125.00 for bingo lotteries in 2009.
The Order in Council has been changed to reflect the current Order in Council 1413/08
which was passed August 12, 2008.
The sections referred to in this by-law pertaining to the Criminal Code of Canada,
namely Sections 206, 207 and 208 have been changed to reflect the changes in the
Criminal Code of Canada.
