RECOMMENDATION:
That the Vision Statement, dated January 2009, prepared for the Ministry of the Attorney
General Branch of the Province of Ontario for the Waterloo Region Consolidated
Courthouse located at 73 -87 Frederick and 35- 39 Weber Street East, Part of Lot 1,
Registered Plan 364 and Part of Lots 5 to 7 inclusive, Registered Plan 372 attached as
Appendix "A" to DTS Report 09 -022, be adopted; and further,
That the Vision Statement and design requirements be implemented through the Site
Plan Approval process, with any modifications to the Visioning Statement being to the
satisfaction of the Director of Planning in consultation with the Supervisor of Site Plan
Development.
REPORT:
City Staff in consultation with Malcolm Leibel, Planning Consultant for the Province (Attorney
General Branch), have prepared a Vision Statement for the subject lands bounded by Frederick
Street to the west, Weber Street to the north, Scott Street to the east and Duke Street to the
south located within the Downtown Design District known as the Market District. The site
comprises an area of 1.09 hectares and is zoned Office District (D -4). While the majority of the
site is vacant there are two existing buildings, one at the corner of Duke and Frederick Streets
(former bus station) and one mid block along the Frederick Street frontage. A building located
at 97 Frederick Street (at the corner of Weber and Frederick Streets) on adjacent lands
currently contains a Queen Anne style structure, which is listed on the Heritage Kitchener's
Inventory of Historic Buildings.
The subject lands are designated as Market District in the Downtown District in the City's Official
Plan. As the subject lands straddle an entire City block in the core area and will result in a
major redevelopment with the potential for several hundred jobs in the core, staff has identified
the need for a "Vision Statement" prior to proceeding with the development. The intent of the
site specific design study is to address several site development matters, such as building
placement, parking areas, site access, and vegetation /buffering with the primary purpose to
attain compatibility between this site and adjacent lands. In addition, these documents will
provide direction for the review of the formal site plan submission and technical analysis that will
be expected in the forthcoming months. The vision statement is to be adopted by Council and
implemented through the Site Plan process.
Staff is recommending that any further modifications to the Vision Statement be to the
satisfaction of the Director of Planning in consultation with the Supervisor of Site Plan
Development rather than having to go back to Council. Implementation of any proposed
modification would be through the site plan process. Applications for Site Plan Approval have

part of the Ministry's Design Excellence Program, in which success is measured by the quality
of the building and its ability to serve all courthouse users, including the public, The Ministry's
Design Objectives include; design excellence, enhanced customer service, operational
innovation, enhanced security, and financial efficiency. The Courthouse site will be developed
with a minimum of LEER Silver Certification as the Ontario Government is committed to high
performance, resource efficiency and cost effectiveness in all of its projects.
FINANCIAL IMPLICATIONS:
There are no expected impacts on the City's Capital Budget.
COMMUNICATION:
None required.
CONCLUSION:
Staff supports the adoption of the Vision Statement.
